provision of Victualls and ammunition for all such fforces of
horse and foot as by his Lopp or his Leivtenant Generall shall
be raised or levyed within their severall and respective divi-
sions for any march or expedition against an Enemy And no
such Officer provider or keeper as aforesaid shall imbezzle or
willingly Spoile or give a false accompt of any such victualls
or amunition soe provided or gathered together or any part
or parcell thereof to whom he is to make his accompt upon
paine of Suffering such punishment as the Generall Court
Martiall shall thinke fitt
Noe Officer or Souldier shall be a victualler in the
army without consent and allowance of the Generall or
of the Officer in Cheife of the Regiment upon paine of being
punished at discretion.
Noe Victualer or Seller of Beere, Ale, wine, or other
strong liquors belonging to the Army shall entertaine
any Soldier in his house, booth, Tent, or Hutt after the warn-
ing peice, tattoe or beate of Drumm at night or before the
beating of the Revelle in the morning, nor shall any Soldier
(within that time) be any where but upon his duty or in his
quarters upun paine of punishment both to the Souldier and
Entertainer at the discretion of a Court Martiall.
Those who are judges in his Lopps Generall Court Mar-
380 tiall or in Regimentall Court Martialls shall hold the same
ranckes in those Courts as they doe in the Army, for Orders
sake and they shall take an Oath for the due administration of
justice according to these articles or (where these articles
assigne no absolute punishment) according to their con-
sciences the best of their understanding, and the Custome of
Warr in like cases, and shall demeane themselves Orderly in
hearing of causes (as becomes the gravity of such a Court)
and before giveing of Sentence, every judge shall deliver his

Vote or Opinion distinctly and the Sentence to be according

to the plurality of Votes, and if there happen to be an equality
of votes the president is to have a casting voice, And when
Sentence is to be given the president is to pronounce it, and
after that the sentence is pronounced the provost martiall shall
have warrant to cause execution to be done according to the
Sentence.
At the Generall Court Martialls there shall be a Clerke
39o who shall be sworne to make true and faithfull records of
all the proceedings of that Court, and there shall be also such
other Officers appointed both for that and also for the Regi-
mentall Court Martialls as shall be necessary and the Generall
Court Martiall may appoint and limitt the ffees of the provost
Martiall Generall as they shall thinke fitt.
