86 Proceedings of the Council of Maryland, 1675-1676.
Lib. R. R. such Souldier shall happen to dye of such his wounds received
in the said Service then provision to be made for maintenance
p. 67 of his Relict and Children (if any he leave behind him) for his
Relict & widdow dureing the time of her widdowhood and for
his Children dureing the time of their infancy or till such time
they may be putt apprentices or come to yeares capable of
getting their Owne Livelyhood.
All Captains shall use their utmost endeavours to have
3'o their Troops and Companyes Compleate and full and
within two dayes after Every Generall muster both the
Captaine and muster master shall send to the Generall if he
requires it a perfect List or Roll of all the Officers Troopers
and Souldiers of their Troopes and Companyes that are in
actuall Service, punctually expresseing at the foot of the Rolls
what new Officers Troopes and Souldiers have been enter-
tained since the preceding muster in lieu of such as have been
cashiered or are deceased, with the day when one dyed or
went of and the other was entertained in his place.
His Lopp the Lord Proprietary doth expressely forbidd
320 any Souldiers duty to be done either of horse or foot by
any other then the Souldier himselfe, but in case of Sicknesse
and disability or other necessary cause his Capt may dispence
with his absence, without causeing him to find another to
serve in his stead.
If any Trooper or Dragooner shall loose or Spoile his
33o horse or any ffoot Souldier his armes or any part thereof
by negligence or gameing he shall remaine in the quality'of a
pioneer or Scavinger, till he be furnished with as good as
were lost at his Owne charge, and if he be not otherwise able
the One halfe of his pay shall be deducted and sett apart for
the providing of it till it be refurnished neither shall any
Souldier pawne or sell or negligently or wilfully breake his
armes or any part thereof, or any hatchetts Spades Shovells
pick axes or other necessaryes of warr upon paine of Severe
punishment at the discretion of the Generall Court Martiall,
And where armes or other necessaries aforesaid shall be
pawned they are to be forfeited and seized on for his Lopps use.
None shall presume to Spoile sell or convey away any
340 ammunition delivered unto him, upon paine of Suffering
death or such other punishment, as the Generall Courte Mar-
tiall shall thinke fitt.
Every Officer Provider or Keeper of Victualls or ammu-
350 nition ordered and appointed to manage the said Office
by his Lopp the Lord Proprietary or in his absence by his Leiv-
tenant Generall for the time being shall use the utmost of his
endeavours according to the best of his Skill power & under-
