28 Proceedings of the Council of Maryland, 1671-1675.
Lib. R. R. to his said Lopp and for that I am informed that sevrall psons
subjects of the States Genrall of the united Provinces have
since taken possession of the said County by force of Armes
to the utter Ruine of sevrall the Inhabitants of the said County
& Disinherizon of his said Lopp of his Just Right, I there-
fore upon the speciall Trust and Confidence that I have in
your fidellity circumspeccon courage and good Conduct doe
hereby Constitute ordaine and appointe you the said Capt
Thomas Howell Comander in Cheif under me of forty able
men to be Raysed & pressed by you in the County of Balta-
more sufficiently provided with Armes and Amunition and
them to traine Muster & Exercise in the Art of Warre, and
from the said County of Baltamore to leade them away, unto
the said County of Worcester and there by force or otherwise
to surprize and take and possesse the said place called the
Horekeele and the said County of Worcester and the same to
Keepe and Defend for the use of the said Lord Proprietary and
in case of any Resistance by any Enemy or Enemyes to fight
and Overcome Kill Destroy and vanquish as occasion shall
Require. And I doe hereby Empower you to prrsse such
men not Exceeding the number of forty in the said County of
Baltamore as you shall Judge fit for such a Designe and also
to prsse all such armes and amunition Provision & horses
necessary for the accomodation of yorself officers & souldiers,
and in case of any Rebellion Tumult or sedition of any of yor
souldiers then I Doe hereby Empower you to pceed agt them
according to Martiall Law and I Doe also hereby Empower
you to make & Constitute such & so many officers millitary
under you for comanding the said party as to you shall seeme
meete And if it shall so happen (as I doe not in the least
doubt) that you shall wynn the said place by assault surprize
or otherwise then to pceed with such Enemy or Enemyes
that shall Resist & oppose you Either according to martiall
Law or otherwise as you shall thinke fit and the Emergency
of the occasion shall Require, and the said place when taken
to Comand yorself or depute such officer or officers for the
same as you can confide in (if you cannot Conveniently stay
yorself to Remaine their) and to keepe and Defend the said
place by force or otherwise, against all psons untill I shall
signify my will & pleasure therein, and I Doe hereby Comand
you to send me speedy notice from time to time of yor pceed-
ings herein, that I may take such ordr about the same as
shalbe for his Lopps Service, and I Doe hereby Comand and
Require all psons to yeild all due obedience to you the said
Thomas Howell in all thinges apperteyning to the office and
Comand hereby conferred on you as they will answere the
Contrary at their perrills and for yor proceedings herein this
