sicke or in danger at any time of death that I should take
care by my last will or other instrument to appoint his Lopps
trusty and welbeloved ffreind Thomas Notley Gent to Succeed
me in the Office and Offices of Goverment of and in the said
province untill his Lopp should appoint and authorize some
other person to exercise and execute the said Offices. And
his Lopp did by the same Instrument of Instructions allow off
authorize and appoint the said Thomas Notley whom I should
so appoint as aforesaid to exercise and execute all and every
the said Office and Offices powers & authorities whatsoever
after my death untill his Lopp shall nominate & appoint some
other person or persons to exercise and execute the same And
his Lopp did thereby in like manner give mee full power and
Authority for him and in his name in case of the death of any
Officer or Officers of the said province or of any of his Lopps privy
Councell or privy Councellours to appoint other fitting person
or persons to execute the Office or Trust of such person or
persons so dyeing as aforesaid untill his Lopps Will should be
declared to the contrary And his Lopp did thereby authorize
such person and persons soe by me to be appointed to execute
and exercise such Office and Offices according to such my
appointment As by the same writeing or instrument of Instruc-
tions may likewise more at large appeare Now Know yee
That I the said Jesse Wharton being at the time of the Seale-
ing and executeing of these presents sicke and weake in body
but of good sound and perfect mind memory and understand-
ing (praised be almighty God for the same) Have in pursu-
ance of the Instructions Orders and Authorities to me given by
his said Lopp Charles Absolute Lord and proprietary of the
Provinces of Maryland and Avalon Lord Baron of Baltemore
&c by the said last recited writeing or Instrument of Instructions
aforesaid (nominated constituted authorized and appointed
and by these presents doe nominate constitute & appoint the
said Thomas Notley Gentleman (in case it shall please God
that I shall happen to dye dureing his Lopps absence out of this
province) imediately from and after the decease of mee the
said Jesse Wharton to Succeed me the said Jesse Wharton in
the Office and Offices of Deputy Leivtenant and Deputy
Govrnor of the said province of Maryland under the Honble
Cecilius Calvert Esqr dureing his Lopps Absence Out of this
province or untill his said Lopp shall nominate appoint and
authorize some other person or persons to exercise and exe-
cute the said Offices of Goverment as aforesaid. And I doe
also by these presents authorize and impower (according to
my instructions aforesaid) the said Thomas Notley to exercise
and execute the said Office and Offices of Goverment as
Deputy Leivtenant Deputy Governour or Cheife justice as
Lib. R. R.
