480 Court and Testamentary Business, 1656/7.
Liber B. Caveat Entred by William Stogden for administration upon the Estate of William Gibbins deceased the 26th of January 1656
The difference depending between David Farrera plft and Henry Hooper defendant being referred to a Jury who re- turned their Verdict as followeth vizt The Names of the men of the Jury Capt William Mitchell foreman. Thomas Reed Iohn Knap mr Thomas Thomas mr Hugh Stanly Henry Keen Robert Taylor Edward Keen Mich: Basey W Turner Iohn Hamleton George B ussey
The particulars being acknowledged by the defendt as well in quantity as price according as they are Stated in the plfs accompt we doe find amid allowe to the plantiff upon the accomnpt the Rest of the accompt being denyed by the defendt and not proved by the plantiff, we doe not find or allow of Soc the Some we finde for the plft upon his accompt is Seventeen hundred Seventy five pounds of Tob and Caske, and the rest of the accompt we leave to future result, and find that the plft is to pay all Costs of Suit in respect there appears to us pounds of Tob amid Caske due to the defendant upon his Claime more then the 1775 pounds of Tob and Caske above mentioned.
Henry Hooper plft These particulars upon the Accompt amount- David Farrera deft ing to Eight hundred fifty five pounds of Tob. and Caske, and one Thousand pounds of Tobacco and Caske upon Bill being acknowledg'd by the defendant, we doe find and allow to the plf being in all 1855 pounds of Tob and Caske, the rest of the accompt being not proved nor acknowl- edged by the defendant we do not Intermeddle with, but find that all the house Except what was formerly mr Iordans Store) was Imployed with mr Hoopers Consent, and remain Still to be Satisfied, but that and the other demands we Leave to future result, and give the plft Cost of Suit
