But vppon the defts oath in open Court that the Gunne nowe pduced was given him by Gov- ernor Calvert The Court conceiving bee had good reason to stand out to a Tryall notwithstanding the demand of the Gunne by Georg Manners the pltes Attorney before the suite com- menced The Court doth order that Court charges bee paid equally betweene the pite and deft
Robt Smith pite This Cause appearing vppon Record to haue Walter Beane deft beene formerly determined vppon a full Tryall by Verdict of Jury and a dismission there vppon 30 Novembr 1648 The Court doth refuse any further to intermedle there- with but doth for ever hereafter cleerely and absolutely dis- misse the pltes suite (being for a Cowe and her Increase) out of this Court with 300 l Tob: Costs to bee paid by the pite to the deft But the deft in open Court remitted the Costs.

servant to the deft according to the Custome. But the deft alleadged hee bought his time of service for 2 yeares, and hee staying not a yeare ran from his service and never afterwards made the same good by his further service. Weh being averred by severall of the Counsell prsent in Court to bee true It is ordered with the defts consent that the Come clothes &c sued for shall goe in satisfaccon of the time of service wanting as aforesaid And the pltes suite to bee dismissed with 60 l Tob: charges to bee paid by the pite to the deft Nichol: Cawseene pite The pltes suite being for three hundred Joseph Cadle deft and thirty pounds of Tob: & Caske the
