security for the Value of the said Ship and Cargoe and what
other charges should accrue upon the said Appeal in Case the
former Iudgment should be affirmed, but were severall times
refused the same by the Governor & answered that he would
keep them himself whereupon the said Luke tendred security
for what charges should be awarded against them upon the
sd Appeal but was from time to time put of and sometimes
told that no security would be taken at other times told by
the said Governor that he did not know whether he would
grant an appeal in our Case or no but the said George Luke
after so long a stay from his own habitation having very
urgent occasion to go home pressed the Govr to tell him
whether he would accept of Security or no but could have no
positive answer from him but all means used to tire him out,
and make him let fall his appeal

By this Publick Instrumt of Protest I Thos Lawrence
Secretary & Notary Publick of Maryland do declare &
make manifest to all Persons whom it may in any ways
Concern that upon the Second day of March 1692
Appeared before me George Luke of Stafford County in the
Colony of Virginia in America Mercht and made Oath that
after Condemnation of the Ship Margarett of London by a
Court of Oyer and Terminer held in the Province of Maryland,
he the said George, and William Burnet Masr of the said ship
appealed from the Iudgment of the said Court to his Majesty
in Councill but were refused the same and an appeal granted
them to the Gov and Councill whereupon the said George
waited upon the Governor full three Weeks, and several times
proffered him security for the Value of the said Ship and
Cargo, and what other charge should accrue upon the said
appeal in Case the former Iudgment should be affirm'd but
