12 Commencing and Entering upon the Execution of the
said Office in protesting against the Govr& Councill (whereof
himself was then a member) for their abitrary & illegal Pro-
ceedings and as such from whom no Iustice or Redress was to
be expected to the betraying of the Government &ca

13 Suggesting and alledging in said Protest severall false
scandalous and opprobious reflections upon the Government
without any Grounds or Motives from the Affidavit or Infor-
mation of the Protestants it plainly appearing & to be made
manifest that an Appeal was granted them to the Govr &
Councill upon Security which they complyed not with neither
when the Councill did sit was there any application made to
them by for or in Behalf of the said Protestants upon their
said Appeal, so that Iustice cannot be said to be denyed them
as he most falsly and maliciously averrs in his said Protest
Memd the Councill upon an Alarm in the Countrey
of the inroad of some Foreign Indians was Conveened
(sooner then was designed) on the Ninth day of March
when the Protestants themselves were actually in Town
& made no application notwithstanding his Excellency
assurance and Promise to take no advantage of their
Lapse of time

The Deposition of George Luke of Stafford County in the
Colony of Virginia in America Mercht maketh Oath that after
condemnation of the Ship Margarett of London by a Court of
Oyer and Terminer held in the Province of Maryland the said
George & Wm Burnet Masr of the said ship appealed from
the Iudgment of the said ship to his Majesty in Councill but
were refused the same and an appeal granted them to the
Govr & Councill whereupon the said George waited upon the
Governor full three weeks, and severall times proffered him
