to have it and that if this Depont would Officiate for half
profitts he would continue him in his place whereupon
this Depont replyed to his Honour that he had formerly
Officiated a long time as Deputy Clerk in the said County and
was now very unwilling to officiate for half Profits under any
person for he knew how to get a great deal more by practising
as an Attorney and when he was put into the said place after
the revolution here (the former Clerk refusing to issue out
writs in their Majestys names) when scarce any one would
undertake to officiate in the said Office and place as Clerk
This Deponent was willing to forego his Interest as practising
as an Attorney which he supposed at that time might have
been more beneficial unto him then the Clerks place meerly to
serve their Majestys and the Country the said place being
then vacant and that his undertaking to Officiate in the said
place did hinder him from undertaking to do any other Busi-
ness whereupon Mr William Dent coming through the Coun-
cill Room where his Honour Sr Thomas and this Depont were
discoursing his Honour Sr Thomas went out and discoursed a
Little while with the said Dent but what their Discourse was
this Deponent knows not his Honour Sr Thomas coming in
again told this Deponent he might continue in his place if he
would give him a Bill under his Hand for three thousand
Pounds of Tobacco for the tenth part of the Fees of the said
place from the date of his Commission to that time, and that if
the tenth part Came not to so much upon perusual and view
of the accompts he would deduct out of the same what was
over & above his tenth part And his Honour Sir Thomas

also told this Deponent that he must give him Bond with two
Sufficient Securitys for the due Execution of his Office in the
said place & yearly to pay unto him a tenth part of the Fees
and Profits accruing and growing due thereby whereupon
this Depont replied that if a tenth part was due unto his
Honour he was willing to allow it and as for giving bond for
the due Execution of his office in the said Place that he had
officiated as deputy Clerk, & Clerk for several Years but Bond
for the due performance of the place before was never required
of him nor any complaint for any misfeazance in the said Place
was made against him that he knew of but if his Honr did
require such a Bond he was willing to give it him only request-
ing his Honour to send up the Bond into Charles County and
there he would give him security because he knew not well
how to give him Security at St Mary's which his Honour
was willing unto and requested this Depont to draw a Bond
for sixty thousand Pounds of Tobacco leaving Blanks for
the securitys Names after a Form he gave him to draw it
by, and also to draw a Commission for the said Clerks
place which his Honour signed and sealed and delivered
