thereupon presented his Petition to this Board which is as foll:

Pet.

To the honble the Deptyes Lieuts in Councill
the humble Petition of Thomas Hussey
of Charles County.

Sheweth
That in Janry last the Worpful1 Comissrs of the said County
pursuant to the Act of Assembly impowering them to rate
Liquors for the ensueing yeare sett so low a price of them
that your Pet chose rather to lett fall than hold his Lycence to
sell the same Yet well weighing the necessity of an Ordinary
for accomodating the County at Court times, the Court House
standing upon your said Petrs Planta and remote from any
other Place fit for the same your Petr proffered to put in his
place an honest person that should answer their Expectations
as the Law required and which was according to the Cov-
enants with Capt Allan of whom they bought the said Court
House, but instead of accepting this reasonable proffer they
resented the same as a contempt of their power in that
matter and at the Instigation of Mr Lynes granted him a
Lycence to keep the said Ordinary and Pettioned your honors
to cause an Acre of Land adjoyning to the Court House to
be laid out to sett the same upon, alsoe purchased of said
Allan which sale if admitted good in Law as your Petr hath
ever been well advised the Contrary, yet the same is contrary
to the said Covenants with said Allan, which was that he or
his assignes should keep or cause to be kept on your Petrs
Plantation the said Ordinary, yet your Petr preferring his Pub-
lick Profit before his private Convenience is and ever was
ready to yeild to the same the said Land soe laid out as to
entrench noe farther than the said Acre upon your Petrs right
in his Freehold Lands, and Houses nor yet to debar the
County any intended conveniencyes granted by said Allan
both which may very well be done, but the said Lynes by vir-
tue of the said Lycence possessed himself of the said Acre of
Land making himself Judge where to have it lye and under
cover thereof hath not only imperiously threatened to take
away your Petrs dwelling Houses, built by him and cofnitted
severall Trespasses on the said Planta and houses but by false
Informations procured a Warrt for what was never denyed
him and then under Colour thereof pretended a power to act
beyond what was either expressed or intended in the said
Warrt supposeing the refusall thereof would give some Coulour
to his intended wicked design of Scandalizing your Petr with
disrespect to the said Warrt which your Petr for this thirty nine
