late of St Maries County aforesaid in the aforesaid Province
Carpenter and William Ayleward late of Somerset County in
the aforesaid Province gentl. together with other popish con-
federates to the Iurors unknowne the third day of Ianuary in
the yeare of our Lord one thousand six hundred Eighty and
Nine at Pottuxon River in Calvert County aforesd in the Prov-
ince aforesaid Not having the feare of God before their eyes,
but being moved by the instigation of the Devill with fires and
armes of their malice forethought in and upon one Iohn Paine
Esqre their Majties late Collector of Pottuxon River aforesaid
(then and there upon the Execution of his Office and in the
peace of God, and our Soveraign Lord and Lady the King
and Queen being) an assault did make and with one gunn
charged with powder and two Leaden bulletts of the value of
one pound Stirl. they the said Nicholas Sewall, Iohn Wood-
cock, George Mason William Burley and William Ayleward
him the said Iohn Paine with the gunn & bulletts aforesaid
then and there in the breast feloniously did Shoote, and
him the said Iohn Paine a mortall wound did give of which
said mortall wound the said Iohn Payne in Pottuxon River in
Calvert County aforesd in their Majties Province aforesaid upon
the day and yeare aforesaid immediately dyed: And soe the
Iurors aforesaid upon their Oaths have said that the said
Nicholas Sewall Iohn Woodcock George Mason William
Burley and William Ayleward him the said Iohn Paine in
manner aforesaid feloniously and barbarously did kill and
murder contrary to the peace of our Soveraign Lord & Lady
the King and Queen their Crowne and Dignity
