Nine at Potuxon River in Calvert County aforsd. in the Prov-
ince aforesaid not having the fear of God before their Eyes but
being mooved by the instigation of the Devill with fire and
armes of their malice forthought in and upon one Iohn Paine
Esqr their Majties late Collector of Pottuxon River aforsd then
and there in the Execution of his office, and in the peace of
God and our Soveraign Lord and Lady the King and Queen
being) an Assault did make and with one Gunn charged with
powder and two Leaden bulletts of the value of one pound
Stirlg they the said Nicholas Sewall, Iohn Woodcock George
Mason William Burley and William Ayleward, him the said
Iohn Paine with the gunn and bulletts then & there in the
breast feloniously did Shoot and him the said Iohn Paine a
mortall wound did give of which said Mortall wound the said
Iohn Paine at Pottuxon River in Calvert County aforesd in
their Majties province aforesaid upon the day and yeare aforesd
immediately dyed. And soe the Jurors aforesd upon their
Oaths say that the said Nicholas Sewall, Iohn Woodcock,
George Mason, William Burley and William Ayleward him
the Sd Iohn Paine in manner aforesd feloniously and barbar-
ously did kill and Murder contrary to the peace of our Sov-
eraign Lord and Lady the King & Queen their Crowne and
Dignity

The prisoners vizt Iohn Woodcock, George Mason Wm Bur-
ley and William Alyeward sett to the barr and the Indictmt
read to them as folls vizt

Memdum that on Wednesday the 22nd day of Aprill in the
yeare of our Lord one thousand six hundred ninety and one
before their Majties Iustices at the City of St Maries by the
Oaths of Sixteen Iurors for our Soveraigne Lord the King
sworne to Enquire &c It was presented. That Major Nicholas
Sewall late of Calvert County in their Majties Province of Mary-
land aforsd gentl. Iohn Woodcock late of St Maries County in
the aforesaid Province gentl George Mason late of Calvert
County in the aforesaid Province Labourer, William Burley
