436 Court and Testamentary Business, 1648.
Liber A. And likewise the Court taking notice of 2 oaths taken Viz: Blanch Oiyuers & Charles Rawlysons) in the behalfe of Tho: Baker appoynted tht writts should be issued to the Sheriffe, to bring the foresd 2 parties to answere, att next Court, touching the sd oaths, wch as yett appeare to haue bene rashly taken by them, unto the Court. warrt to the Tenure of the Order.
Mrs Margarett Brent complayneth agst Thomas Bradnox, for tht he the sd Tho: Bradnox somtime during the late Rebel lion in Kent, carryed himselfe as Capt of a certaine Crew of Rebells in the Sd lie, & made her howse, his Garryson for some time. During wch time, he or his Company burned downe a howse apperteyning to her, killed some cattle, & spent & wasted Come & other prouisions of hers. Likewise tht he hath (since the reducing of the Iland) held an intel ligence wth the Rebells, after they were departed the Iland. whereby she probably beieiueth tht Kent Mill came to be fyred, & certaine cattle kilid att the same time, by the sd Rebells. And likewise tht he the sd Tho: Bradnox hath kilid one or more Beasts apperteyning to her. Warrt to the Sheriffe ret. Decembr Court.
This day being the last day of the Court, Edward Commins came before the Court & desyreth & petitioneth. That whereas hee had bene arrested in a suite layd agst him in the behalfe of the Ld Propr wch he was to answere in Decembr Court next That he might answere to the sd suite This prnt Court. And his Lps Attorney being called, who being likewise willing to haue the cause heard & determined in this Court. The Court appoynted the sd Attorney to prosequute the sd suite on this day. Therfore uppon the Compit of Mrs Margarett Brent his Lps Attorney agst Edw: Commins on the behalfe of the Ld propr for carrying certaine persons away out of the Sheriffs hands, under Exeqn The deft maks answere, That the Sheriffe fore warn'd him, to carry away the sd persons & tht they were under exeqn But bee conceiued them not under exeqn because they had their liberties in goeing to & againe up & downe the County. And for hauing uttered any contemptuous words eyther agst the prson of the Gour or the Gouermt he utterly denyeth. George Manners deposeth in ditta caâ, That he forewarned the sd Ldw: Lommins (being sent thertore unto him by the Gour) to carry away the foresd persons. And the sd Edw: Commins made answere saying How durst the Gouernor send such
