The Prescription Drug Affordability Board works to protect Maryland residents, State and local governments, commercial health plans, health care providers, Maryland licensed pharmacies, and others within the health care system from the high costs of prescription drugs.
In conjunction with the Prescription Drug Affordability Stakeholder Council, the Board identifies circumstances under which the cost of a prescription drug product may create or has created affordability challenges for patients and the State health care system; and establishes criteria that the Board will use to set an upper payment limit for a prescription drug product after considering certain factors (Code Health-General Article, sec. 21-2C-01 through 21-2C-16).
The Board consists of five members and five alternate members. The Governor, Senate President, House Speaker, and Attorney General each appoint one member and one alternate to five-year terms. The Senate President and House Speaker jointly choose the Chair. The Attorney General is legal adivsor to the Board (Chapter 692, Acts of 2019; Chapter 425, Acts of 2020; Chapter 241, Acts of 2022; Chapter 49, Acts of 2023; Code Health-General Article, sec. 21-2C-03).
The Prescription Drug Affordability Board is assisted by the Prescription Drug Affordability Stakeholder Council.
Twenty-six members constitute the Council. Nine are appointed by the Governor, nine by the Senate President, and eight by the House Speaker. All serve three-year terms (Code Health-General Article, sec. 21-2C-04).
