(290) March Court Anno Domini 1748 Requested but the same to him hither to to Pay or him for the same in any sort to Content hath hither to Altogether Refused and still doth Refuse to the Damage of the same Samuel Hanson Jun Two Thousand Six Hundred & Seventy Nine Pounds of Tobacco & therefore Suit is brought and so forth John Doe Pled.s &C.a & Rich.d Roe 1744 William Mackhorne D.r 1745 C.r
Whereupon into Court here in his Proper person Comes Thomas S.t Clair of Charles County Planter and becomes Pledge and Security for the said William that if it should happen the s.d William in the Plea afs.d should be Convict then the said Thomas yeilded and Granted that as well the Damages afs.d as all Costs which to the said Samuel in this Part should be adjudged of his Lands & Chattles should be made and Levied to and for the use of the said Samuel that if it should happen that the said the Damages and Costs afs.d to the said Samuel should not Pay or his body into the Custody of the Coroners by Reason thereof Render And the afs.d William by Henry Darnall his attorney Comes and defends the force and Injury when &C.a and says that he Cannot deny the Action afs.d of him the said nor but that he did assume upon himself in manner and form as the said Samuel against him hath Complained nor also but that the said Samuel hath Sustained Damages by means of not Performing the Premises and Assumptions afs.d to One Thousand Three Hundred Thirty Nine Pounds and an half p.d of Tobacco as the said Samuel above in declaring Supposes Whereupon the said Samuel by his atty afs.d Prays Judgment and those Damages so acknowledged together with his Costs and Charges by him about his suit in this Part laid out and Expended to him to be adjudged Therefore it is Considered by the Court here that the said Samuel do Recover against the said William his Damages afs.d to Thirteen Hundred Thirty Nine Pounds and an half Pound of Tobacco above acknowledged as also ^the sum of^ Three Hundred Thirty Nine Pounds and one Quarter of a pound of Tobacco for his Costs and Charges by him about his suit in this Def.t in mea Part laid out and Expended on his assent by the Court here adjudged and the said William in Mercy &Ca
