(289) And now here at this day to wit the second Tuesday in March afs.d Comes the said John by Jeremiah Chase his attorney and offers himself against the said William in the plea afs.d and the sheriff afs.d Returns to the Court here the Writ afs.d thus Indorsed Viz.t Charles County sst I hereby Certify to the Worshipfull the Justices within mentioned that by Virtue of the within Writ to me directed on the 24.th day of November 1748 I attached in the hands of the within mentioned John Wheatly Two Thousand One Hundred and Sixty five Pounds of Tobacco as the Effect of the within mentioned William Carter and I have made known to the above Garnashee that he be and appear before the Justices within mentioned at the time & Place within Prescribed to shew Cause If any he had why the same shou'd not be Condemned according to Law Viz.t on the 26.th day of November 1748 before John Estep and Tho.s McPherson Good and Lawfull men of my Bailywick as I am hereby Commanded So answers Sam: Hanson She: Whereupon the afs.d John by his attorney afs.d Comes and Prays Condemnation of the sum of Two Thousand One Hundred and Sixty five Pounds of Tobacco so as aforesaid in his hands Attached Therefore it is Considered by the Court here that the said John Wheatly have Condemnation of the afs.d Sum of Two Thousand One Hundred and Sixty five Pounds of Tobacco in his own hands attached by the Court here adjudged according to the form force and Effect of the act of Assembly in those Cases made and Provided Mem.o Jeremiah Chase security on Condemnation
Charles County ss.t William Machorne late of Charles County Planter was attached to answer unto Samuel Hanson Jun of a plea of Trespass upon the Case and so forth And Whereupon the same Samuel Hanson Junior by Jeremiah Chase his attorney Complains that whereas the said William the fourteenth day of October In the year of our Lord one Thousand Seven Hundred and forty seven at Charles County afs.d was Indebted to the said Samuel In the sum of one Thousand Three Hundred and Thirty Nine and a half Pound of Tobacco for divers articles lying Properly in an account as by the Particular Account thereof here with into Court brought may appear and being so thereof Indebted the afs.d William in Consideration thereof afterwards to wit the day and year afs.d at the County afs.d upon himself assumed and to the s.d Samuel Hanson Jun then and there faithfully Promised that he the afs.d William the afs.d Sum of one Thousand Three Hundred and Thirty Nine and a half Pound of Tobacco to the said Samuel when thereunto afterwards he should be Requested well and truly would Content and Pay Nevertheless the afs.d William his Promise and Assumption afs.d not Regarding but minding and fraudulently Intending the same Samuel In this Part Craftily and Subtilly to deceive and defraud the afs.d W.m the afs.d sum of one Thousand Three Hundred Thirty Nine and a half Pounds of Tobacco or any Part thereof to the same Samuel hath not Paid nor him for the same in any sort Contented altho the afs.d Wm Mchorn afterward to wit the fifteenth day of June In the year of our Lord one Thousand Seven Hundred and forty Eight and often afterwards at Charles County afs.d by the same Saml hath been (Requested) |
