Court 1747 The Deposition of Barton Smoot aged Thirty Six years or thereabouts being Sworn on the holy Evangelists to sages that about Nineteen or Twenty years ago he Came to the place where he Now stands in Company with his father & M.r John Chandler in order to Run out a tract of Land Called Rich Hills to find thereby a tract of Land Call'd Lomaxes Addition & he further sayes that he Saw his Father put his hand on a White Oak where he now stands it being in a branch of Zachiah Swamp by the side of a Ditch on the North Side of the Plantation of Charles Byrn and heard him say that the said White Oak was the beginning Bound Tree of a Tract of Land Call'd Rich Hill and he farther says that the said John Chandler said yes and it is the bound Tree of Alexander Hawkins's Land but the old son of a bitch was afraid of his Money and Lets Charles Byrn but Down his Land & further he sayeth Not sworn the 3d Day of April Anno Domini 1747 Barton Smoot The Deposition of John Hammill aged fifty four years or thereabouts being sworn on the holy Evangelists of Almighty God sayes that within this Twenty Two years he has made sundry private surveys from a White Oak where he Now Stands it being on a branch of Zachiah Swamp and by the side of a Ditch on the North side of the Plantation of Charles Byrn and that he always understood the said White Oak was the beginning Bound tree of a Tract of Land in Possession of Doctor Gustavas Brown & Mr Charles Courts but he says he Could not Charge his memory who shewd him the said Tree and he further say's that within this Twelve Month he was in Company with Charles Byrn and falling into Discourse about the said Land the said Byrn Charg'd him with shortness of Memory and told him that he shew'd him the afs.d tree himself and that it was a bound tree made by a Jury for the beginning tree of Rich Hills and further he saith not sworn this 3.d Day of April Anno Dom 1747 John Hamill The Deposition of Stephen Chandler Aged about Twenty Seven years being sworn on the holy Evangelists say's that about a year ago he Come to the place Where he Now stands it being in a branch of Zachiah Swamp by a Ditch on the North Side of Charles Byrns Plantation where Doctor Brown & Mr Charles Courts was [illegible] a Division Line of a tract of Land Call'd Rich hill's and he understood a White Oak standing by the side of the aforesaid Ditch where he Now stands was the beginning bound tree of the said Tract of Land Call'd Rich hill's & he further say's that some time since he was Company with Charles Byrn who shew'd him the said tree and told him it was the Beginning bound tree of Tract of Land Call'd Rich hill's & further sayeth not sworn this 3d day of April Anno Domini 1747 Stephen Chandler Charles County ss.t By Virtue of the within Commission to us Directed to Examine Evidences Touching the bound of a Tract of Land Call'd Moretown in Possession & Occupation of Alexander Smith Hawkins In Obedience there unto we did meet on the Premises (all Requisites being duly Performed according to Law) and then & there did Examine all Evidences which to us was Offer'd by the sworn Depositions hereunto annexed may appear Witness our hands & Seals this third day of April Anno Dom 1747 Jn.o Winter (H) Sam.l Chunn (H) Jn.o Hanson Jun (H) |
