June Court Anno Domini 1747
(79) Day aforesaid before Robert Hanson Gent and his associates then and still our Justices within our County aforesaid &C for Commission to Examine Evidences to Prove and perpetuate the Memory of the bounds of the said Tract of Land according to the Directions of the Act of Assembly late made and Provided Know ye that we have given you any Three or Two of you (not being [illegible] any way Related to the Petitioner contig^u^ous Proprietor nor interested in the s.d Land and having taken the oath prescribed by the above Named Act of Assembly) full power and Authority to Examine upon their Corporal oaths to be by you any Three or Two of you administred all Witnesses which shall be Nominated to you any Three or Two of you by the above Named Petitioner or other person Concerned touching their knowledge of the Bounds of the Tract of Land above named or the bounds of any other Lands whereof the afs.d Tract depends or whereto it relates and therefore We command you any three or Two of you that you call and Cause to Come before you any Three or Two of you all Wittnesses so Nominated at a Certain day by you any Three or Two of you to be appointed upon the abovementioned Tract of Land and the Examination of every Witness so Called before you that you any Three or Two of you Receive and that same Examination you any three or Two of you carefully Reduce into Writing in the Presence of all parties Concerned that shall be there Present and the Examination so taken as [illegible] any three or Two of you are to Return to the Justices of our Court with all Convenient speed under your seals or the seals of any Three or Two of you together with this Writ Provided always that all Parties Concerned living within or without the County aforesaid have Notice according to the Directions of the Act of Assembly before mentioned of the day and place of the Execution of this our Commission before the Execution thereof and that you any Three or Two of you Return to our Justices aforesaid with all Convenient Speed a Certificate of such Notice Given together with the Examination of the Witnesses Witness Robert Hanson Gent one of our said Justices of our said Court at Charles Town afs.d the Twelfth day of March in the Thirty Second year of our Dominion &Ca Anno Domini 1746 Issued March 26.th 1747 Edmd Porteus Clk And now here at this day to wit the Second Tuesday in June aforesaid George Maxwell and John Estep two of the Commissioners aforesaid Return to the Court here the Commission afs.d with the subsequent Depositions and Certificate thereunto Annexed Vizt Charles County sst 24th May 1747 The Deposition of Jeremiah Bowers aged Thirty Seven years who being sworn on the holy Evangelists of Almighty God Declares that Twenty odd years agoe William Rous told him that a Red Oak tree by which he Now stands (closs by the main Road Side within Two Hundred yards of of Gladding Rolling house) was the Corner tree of Esq.r Plater's Land & that James Thompson and John Galwith told him that the said Red Oak tree was the Corner tree of said Platers Land which Red Oak tree stands on the same Ridge where John Farthing deponed James Thompson told him the bounded oak of Massons Land stood and further this Deponant saith not Jeremiah Bowers |
