76) March Court Anno Domini 1746 Whereupon the sa^i^d John & Company by their Attorney aforesaid prays Judgm.t and their Debt so acknowledged together with their Costs & Costs & Charges by him about their suit in this part sustained to them to be adjudged Therefore it is Considered that the said John & Company Recover against the said George their Debt to Twelve Pounds Ten shillings Currency above acknowledged as also Two Hundred & Ten pounds of Tobacco for their Costs and Charges by him about their suit in this part laid out and Expended on their assent by the Court here adjudged and the said Def.t in mer George in Mercy &Ca
This being an action upon the Cause for the Recovery of Three Thousand Nine Hundred and Seventy One pounds of Tobacco there on account to the said Mess.rs Stephenson and Steel from the said James Middleton & Ignatius Gardiner Ex.rs aforesaid to the said Stephenson and Steel the said James & Ignatius Ex.rs afs.d was by Virtue of a Capias Ad Respondendum Returnable before his Lordships County Court on the Second Tuesday in June In the year of our Lord one Thousand Seven Hundred and forty Six arrested and then and there appeared And the said James and Ign.s Ex.rs afs.d by Philip Key their Attorney Comes and defends the force and Injury when &C.a and prays Leave thereof to Imparle hereto until the Next Court to be holden at Charles Town on the Second Tuesday in August Next and thereof ^prays^ it and the same day is given the same Stephenson and Steel here &Ca At which day to wit the Second Tuesday in August afs.d Comes here as well the said Stephenson and Steel as the said James & Ignatius Ex.rs afs.d and the said James and Ignatius Ex.rs afs.d by their ^s.d^ attorney prays further Leave thereof to Imparle here to until the Next Court to be holden at Charles Town on the Second Tuesday in Novr Next and they have it and the same day is given the same Stephenson and Steel here &Ca At which day to wit the Second Tuesday in November afs.d Comes here as well the said Stephenson & Steel as the said James and Ignatius Ex.rs afs.d and the said James and Ignatius Ex.rs afs.d by their afs.d atty prays further leave thereof to Imparle hereto until the Next Court to be holden at Charles Town on the Second Tuesday in March Next and they have it and the same day is given the same Stephenson & Steel here &c And now here at this day to wit the Second Tuesday in March afs.d Comes here as well the said Stephenson and Steel by their attorney afs.d as the said James and Ignatius Ex.rs afs.d by their attorney and the said Stephenson and Steel by their attorney afs.d pray Judgment of his Damages & Costs by occasion of the Premises to them to be adjudged in the hands of the said James and Ignatius Ex.rs afs.d when of the Goods and Chattles of the afs.d Vincint so much in their hands they shall have Therefore it is Considered that the said Stephenson & Steel Recover against the said James & Ign.s Ex.rs afs.d the sum of Three Thousand Nine Hundred and Seventy One Pounds of Tobacco their Damages afs.d and also the Sum of Three Hundred and four pounds of Tobacco whereof the Goods & Chattles of the said Vincint so much in their hands they shall have by the Court hereof their assent Adjudged for their Costs and Charges by them about their suit in this part laid out and Expended Def.t in mer and the said James and Ignatius Ex.rs afs.d in mercy &Ca |
