Def.t in mer   Muschett on his assent by the Court here adjudged and the said Thomas in mercy &C

Judgment by Nonsum Informatus

Charles County ss.t  Alexander Smith Hawkins late of Charles County Gent.n otherwise Called
Alexander Smith Hawkins of Charles County Gent.n was summoned to answer unto W.m
Middleton of a plea that he render unto him the Just and full sum of Sixteen Thousand pounds
of Good Sound Merchantable Leaf Tobacco in cask which to him he owes and Unjustly Detains
& so forth

And Whereupon the same W.m by Jeremiah Chase his attorney saith that whereas the
afs.d  Alexander Smith by the name of Alexander Smith Hawkins of Charles County Gent.n
on the Twenty fifth day of November In the year of our Lord one Thousand Seven Hundred &
forty Six at Charles County afs.d by his Certain Writing obligatory under the hand & Seal of
the said Alexander Smith bearing date the day and year last Named Granted himself
be held and firmly bound to the afs.d Jn.o Marten Jun.r his Heirs Ex.rs Adm.rs or Assigns in the
Just and full sum of Sixteen Thousand pounds of tobacco as afs.d to be paid unto the said
John Marten Jun.r his Certain Attorney Ex.rs Adm.rs or Assigns at or upon the first day of
January Next Ensuing the date hereof and the said William further saith that the afs.d John
after the Second day of January & in the year afs.d to wit the Second day of March
In the year abovesaid at Charles County afs.d by his Certain Writing under the hand &
seal of him the said John Marten Jun.r bearing date the day and year last ment.d
according to the form & Effect of the Act of Assembly in such Cases made & Provided assigned the s.d
Writing obligatory to the said W.m for Value Received as therein mentioned of which said
assignment the said W.m afterwards to wit on the said Second day of March in the year
last mentioned at Charles County afs.d to the said Alexander Smith gave notice and the s.d
W.m in fact saith that the said Alex.r Smith altho' often Required the afs.d Sum of Sixteen
Thousand pounds of Tobacco afs.d to the said W.m hath not Paid nor any part thereof nor for the
same in any sort Contented but the same to him to pay hath hitherto altogether Refused by
Virtue of which said Assignment of the Act of Assembly by Action hath accrued Yet the afs.d
Alex.r Smith altho' often Required the afs.d sum of Tobacco to the s.d W.m hath not Rendered or paid but
the same to him to Render and pay hath hitherto altogether Refused and stil doth Refuse to the
Damage of the s.d W.m Twenty Thousand pounds of Tobacco and therefore he brings suit so forth
and he brings here into Court as well the Writing obligatory afs.d as the Writing of Assignment
afs.d which the Debt & Assignment thereof as afs.d Testify the dates whereof on the Second Days
& years afs.d                                                                                                             John Doe

And the said Alexander Smith Hawkins by Henry Darnall his attorney comes & defends the force &
Injury when and so forth & Prays a hearing of the writing obligatory afs.d and it is Read unto him & he
prays a hearing of the Condition of the s.d obligation and it is Read to him in these Words
The Condition of the above obligation is such that if the above bound Alexander Smith
Hawkins his Heirs Executors or Adm.rs do & shall well and truly pay or Cause to be paid unto the s.d
John Marten Junior or his Certain attorney Executors Adm.rs or Assigns the Just Sum of Eight
Thousand pounds of good Sound Merchantable leaf Tobacco in cask in Charles County aforesaid
at or upon the first day of January Next Ensuing the date hereof with legal Interest for the same then
the above obligation to be Void Else to Remain in full force and Virtue in Law but if default be made in
the payment of the said Sum of Eight Thousand Pounds of Tobacco as afs.d then I Impower my attorney
in any Court of Record in the Realms of Great Britain France or Ireland or within the province of
Maryland or Other his Majesty's Dominions to appear for me at the suit of the above Mentioned
