                       March Court Anno Domini 1746                                 (67

Under the hand and Seal of the said William bearing date the day and year
last Named Granted himself to be held and firmly bound to the aforesaid
Cornelius Sandford his Heirs Ex.rs Adm.rs or Assigns in the Just & full Sum of
Twelve Thousand Two Hundred Pounds of Good Sound Merchantable
Leaf Tobacco in Cask to be paid unto the said Cornelius Sandford his Certain
Attorney Executors Administrators or Assigns at or upon the first day of
January Next Ensuing the date hereof and the said John further saith
that the aforesaid Corn.s Sandford after the Twenty first day of September In
the year of our Lord one Thousand Seven Hundred and forty Six at Charles
County afs.d by his Certain Writing under the hand and Seal of him the said
Corn.s Sandford bearing date the day and year last mentioned according to
the form and Effect of the Act of Assembly in such Cases made & Provided
Assigned the said Writing Obligatory to the said John for Value Received as
therein mentioned of which said assignment the said John afterwards to
wit on the said Twenty Seventh day of February in the year last mentioned at
Charles County afs.d to the said W.m Theobalds gave Notice and the said John in fact
saith that the said William altho' often Required the afs.d sum of Twelve Thous.d
Two Hundred Pounds of Tobacco to the said John hath not paid nor any part thereof
nor for the same in any sort Contented but the same to him to Pay hath hitherto
Altogether Refused by Virtue of which Assignment and of the Act of Assembly
Action hath accrued to the said John to have and Require of the said William
the aforesaid sum of Twelve Thousand Two Hundred pounds of Good Sound
Merchantable Leaf Tobacco Leaf Tobacco in Cask aforesaid  Yet the aforesaid W.m
altho often Required the aforesaid Sum of Tobacco to the said John hath not Rendered
of paid but the same to him to Render & Pay hath hither to altogether Refused
and Stil doth Refuse to the Damage of the said John Twenty Thousand p.ds of
Tobacco and therefore he brings Suit and so forth and he brings hereinto Court
as well the Writing Obligatory afs.d as the Writing of Assignment aforesaid which
the Debt and Assignment thereof as afs.d Testify the dates whereof are the Several
Days & years aforesaid                                                                              John Doe

And the said W.m Theobalds by Thomas Clark his attorney comes & Defends
the force and Injury when and so forth and prays a hearing of the Writing
Obligatory aforesaid and it is Read unto him in these Words
                                                                                     The Condition
of the above Obligation is such that if the above bound W.m Theobalds Richard
Gambia & Thomas Mudd their Heirs Ex.rs or Adm.rs do and shall well and truly
pay or Cause to be paid unto the said Corn.s Sandford his Certain Attorney Ex.rs Adm.rs
or Assigns the Just Sum of Six Thousand one Hundred pounds of Good sound
Merchantable Leaf Tobacco in Cask in Charles County at or upon the first day of
January Next Ensuing the date hereof with Legal Interest for the same than the above
