(5) The Directions of the Act of assembly in such Cases late made and provided and for that the said Susanna Cannot pay or procure any any person to be Security for her fine aforesaid It is Ordered that the Sheriff take the said Susanna to the Whipping Post and having stripped her from the Waist upwards there give her Twelve Lashes on the Bare Back Back for the Offence afs.d And afterwards to wit the Same Second Tuesday In March the Sheriff afsd returns to the Court that he hath done Executon on the said Susanna And thereupon the said Susanna together with Richard Marshall her Mainpernor from the Force and Effect of the Recognizance aforesaid are Acquitt Ordered that the said Susanna Recognize In the Sum of Ten pounds Current Money with one Surety in the Like Sume for her appearance here on the Second Tuesday in June next to Testifye for the Lord Propry against a certain Thomas Henson Marshall of and concerning his begetting a Bastard Child on the Body of the said Susanna of which He stands Presented Whereupon Into Court here in her proper person Comes the aforesaid Susanna Black of Charles County Spinster together with Richard Marshall of same County Gent and Acknowledge themselves to Owe and Stand Justly Indebted unto his Lordship the Lord Proprietary In the full and Just Sume of Ten pounds Current Money Each which Sums they and Each of them severally Yeilded and Granted should and might be made and Levied on their & Each of their Goods and Chattels Lands and Tenements to the Use of his said Ldship his Heirs and Successors On Condition that the said Susanna Black do make her personall appearance here on the Second Tuesday In June next then and there to give Evidence on Behalf of his Lordship the Lord Proprietary against a certain Thomas Henson Marshall of & concerning his Begetting a Bastard Child on the Body of the said Susanna Whereof he is presented and not Depart the Same Court wtout Licence Memd Richard Marshall pays fees
