46) March Court Anno Dom 1746 himself against the said John Chandler and thereof [illegible] Returns to the Court here that he has taken the body of the said John Chandler And the aforesaid John Chandler ^in his Proper Person^ Comes and defends the force and Injury when &C.a and saith that he Cannot deny the action afs.d of him the said George nor but that he owes to the said George the sum of Twenty nine pounds Twelve shillings and Six pence Currency and no more Therefore it is Considered by the Court here that the said George do Recover against the said John his Debt aforesaid and his Damages by Occasion of Detaining that Debt to Two Hundred and Eighty pounds of Tobacco to the same George on his assent by the Court here adjudged and the said Def.t in mer John Chandler in Mercy &Ca
answer unto John Smith Prather of a Plea of Trespass upon the Case And Whereupon the said John Smith by Henry Darnall his attorney Complains for that whereas the said W.m after the first day of May in the year of our Lord one Thousand Seven Hundred and five (to wit) the Thirteenth day of August In the year of our Lord One Thousand Seven Hundred and forty Six at Charles County afs.d did make his Certain Note in Writing called a Promisary Note with his proper Name & hand thereto subscribed bearing date the same day and year last mentioned and the said Note unto the said John Smith Prather at the County afs.d did deliver by which said note the said W.m did Promise to pay John Smith Prather the full and just sum of Six Pounds Eighteen shillings and Two pence half penny paper Currency for value Received by Virtue whereof and Also by force of the statute the said William became Liable and Chargeable to pay unto the said John Smith Prather the sum of six Pounds Eighteen shillings and Two pence half penny paper Currency according to the Tenor of the Note afs.d and so being Chargeable the said William afterwards (to wit) the day and year last mentioned at the County afs.d upon himself assumed & to the said John Smith Prather then and there faithfully Remised that he the said William the said sum of six pounds Eighteen shillings and Two pence half penny Paper Currency to the said John Smith Prather when thereunto afterwards he should be Requested well and truly would Content and pay Nevertheless the said William his Promise and Assumption afs.d not in the least Regarding but minding and fraudulently Intending him the said John in this part craftily and subtilly to deceive and defraud the said William the said sum of six pounds Eighteen shillings and Two pence half penny paper Currency or any part thereof to the said John hath not paid altho so to do the said William by the said John hath been Requested to wit on the First day of January In the year of our Lord one Thousand Seven Hundred and forty six and often before and since at Charles County afs.d to pay the same but that unto him hither to to Pay or Content the said William hath altogether refused and still doth Refuse to the Damage of him the said John Smith Prather Thirteen Pounds sixteen shillings and five pence paper Currency and therefore he brings Suit and so forth Pled.s &C.a |
