          March Court Anno Domini 1746                                 (43)

and Company then and there faithfully Promised that the said Dan.l
the said sum of one Thousand pounds of Tobacco to the said Matt.w & Com would
well and truly Content and pay when thereunto afterwards he should be
requested
                Nevertheless the said Daniel his Promise & Assumption
afs.d in form afs.d made not in the least Regarding but minding and
fraudulently Intending them the said Matthew & Com in this part Craftily
and subtilly to deceive and defraud the said Daniel the said Sum of one
Thousand Pounds of Tobacco or any part thereof to them the said Matt.w & Com
hath not paid or in any sort Contented altho so to do the said Daniel was
on the Twenty Second day of July in the year of our Lord One Thousand Seven
Hundred and forty Six and often before and Since at Charles County afs.d
by the said Matthew & Com Requested but the said Daniel the said Sum of
One Thousand pounds of Tobacco or any Part thereof to them the said Matt.w & Com
to pay or in any sort to Content hath hither to altogether Refused and Still
doth Refuse to the Damage of them the said Matt.w & Com Two Thousand
Pounds of Tobacco therefore Suit brought & so forth

Holy Evangelists of Almighty God that the above Account is just & true and that
has Received no part or parcel security or satisfaction for the same

Whereupon into Court here in his Proper Person Comes Walter Dodson
of Charles County PLanter and becomes pledge and security for the said that if
it should happen the said Daniel in the plea afs.d should be Convict that then
the said Walter yielded and Granted that as well the Damages afs.d as all Costs
which to the said Matthew & Com in this part should be adjudged of his
Lands and Chattles should be made and Levied to and for the use of the said Matt.w
& Company that if should happen ^that^ the said Daniel the Damages & Costs afs.d to the said
Matt.w & Com should not pay or his body into the Custody of the sheriff by
Reason thereof Render
                                               And the afs.d Daniel in his Proper Person Comes
and defends the fore and Injury when &C.a and says that he Cannot Deny the
