March Court Anno Dom 1746
It was Commanded that hereof that he should take James M.cIntosh late of Charles County weaver if &Ca and him safe keep so that he should have his body before the Justices of the Lord Proprietary of his Next County Court to be holden at Charles Town on the third Tuesday in March Next to Answer unto William Middleton of a Plea of Trespass upon the Case and that he should have then and there this Writt &Ca At which day to wit the Second Tuesday in March aforesaid Comes the said William by Jeremiah Chase his Attorney and offers himself against the said James MacIntosh and the sheriff afs.d Namely Samuel Hanson Gent Returns to the Court here that he has taken the body of the said James MacIntosh Whereupon at the prayer of the Plft it is Ruled by the Court here that the said James Give Special bail in the plea aforesaid and for want thereof the said James Present here in Court is Committed into the Custody of the sheriff Namely Samuel Hanson Gent there to remain untill &Ca And the said James in Custody as aforesaid in his Proper Person Comes and defends the force and Injury when &C.a and saith that he Cannot deny the Action afs.d of him the said William nor but that he owes to the said William the Sum of Eighteen Hundred and Twenty Nine pounds of Tobacco and no more Whereupon the said William by his Attorney afs.d prays Judgment and those Damages so acknowledged together with his Costs & Charges by him about his suit in this part laid out and Expended to hi to be adjudged Therefore it is Considered that the said W.m Recover against the said James his Damages afs.d to Eighteen Hundred and Twenty Nine pounds of Tob.o above acknowledged and also the sum of one Hundred and Ninety one pounds of Tobacco for his Costs and Charges by him about his suit in this part laid out and Expended on his Assent by the Court here adjudged and the said Def.t in Mer James in Mercy &Ca
Answer unto Matthew Hopkins & Company of a Plea of Trespass upon the Case And Whereupon the said Matthew & Com by Thomas Clark their attorney Complains for that whereas the said Daniel on the Twenty Second day of July In the year of our Lord One Thousand Seven Hundred and forty five at Charles County aforesaid was Indebted unto the said Matthew & Com in the Sum of one Thousand Pounds of Tobacco for divers Particulars lying Properly in Account as by a Particular account thereof herewith into Court brought may appear and the said Daniel being so thereof Indebted in Consideration thereof afterwards to wit the day and year afs.d at the County afs.d upon himself assumed and to the same Matt.w (& Com) |
