(410) March Court Anno Domini 1747 Whereupon at the prayer of the said Joseph it is Ruled that the said ^Tho.s^ Give ^the^ special bail in the plea afs.d and for want thereof the said Thomas Present here in Court is Committed into the Custody of the sheriff Namely Thomas Hungerford Gentleman there to Remain until &Ca And the said Thomas in Custody as afs.d in his proper Person Comes and Defends the force and Injury when &C.a and saith that he Cannot deny the action afs.d of him the said Joseph nor but that he owes to the said Joseph the sum of one Thousand seven Hundred and Three Pounds of Tobacco as he above in declaring supposes Therefore it is Considered that the said Joseph Recover against the said Thomas his Damages afs.d to one Thousand seven Hundred and Three Pounds of Tobacco above acknowledged as also Two Hundred seven and a half Pound of Inspected Tobacco for his Costs and Charges by him about his suit in this part laid out and Def.t in mea Expended on his assent by the Court here adjudged and the said Thomas in Mercy &Ca
Charles County ss.t William Macdaniel late of Charles County Mill Right was attached to answer to Joseph Aderton of a plea of Trespass upon the Case and so forth And Whereupon the same Joseph Aderton in his proper Person Complains that whereas the said William the first day of December in the year of our Lord one Thousand Seven Hundred and forty six at Charles County afs.d afs.d was Indebted to the said Joseph Aderton in the sum of Two Thousand four Hundred and a half Pound of Tobacco for divers articles lying Properly in an account as by the Particular account thereof herew.th into Court brought may appear and being so thereof Indebted the afs.d Wm M.cDaniel in Consideration thereof afterwards to wit the day and year afs.d at the County afs.d upon himself assumed and to the said Joseph then and there faithfully Promised that he the afs.d William the aforesaid sum of Two Thousand four and a half pound of Tobacco to the said Joseph when thereunto afterwards he should be requested well and truly would Content and Pay Nevertheless the aforesaid William Macdaniel his Promise & Assumption afs.d not Regarding but minding and fraudulently Intending the same Joseph In this part Craftily and subtilly to deceive and defraud the afs.d William the aforesaid sum of Two Thousand four and a half Pound of Tobacco or any part thereof to the same Joseph hath not Paid nor him for the same in any sort Contented altho the afs.d W.m afterwards to wit the first day of December in the year of our Lord one Thousand seven Hundred and forty seven and often afterwards at Charles County aforesaid by the same Joseph hath been Requested but the same to him hitherto to Pay or him for the same in any sort to Content hath hither to altogether Refused and still doth Refuse to the Damage of the same Joseph Aderton four Thousand and Nine pounds of Tobacco & Therefore suit is brought and so forth John Doe Pled.s &C.a & Rich.d Roe |
