(389) in Consideration thereof afterwards to wit the day and year afs.d at the County afs.d upon himself assumed and to the said Benjamin Gwinn then and there faithfully Promised that he the afs.d Nathaniel Morrell the afs.d sum of Three Thousand Eight Hundred Pounds of Tobacco to the said Benjamin Gwinn when thereunto afterwards he should be requested well and truly would Content and Pay Nevertheless the afs.d Nathaniel Morrell his Promise and assumption afs.d not Regarding but minding and fraudulently Intending the same Benjamin Gwinn in this Part Craftily & Subtilly to deceive and defraud the afs.d Nathaniel the said sum of Three Thousand Eight Hundred Pounds of Tobacco or any Part thereof to the same Benjamin Gwinn hath not Paid nor him for the same in any sort Contented altho the afs.d Nathaniel Morrell afterwards to wit the Twenty fifth day of November in the year of our Lord One Thousand Seven Hund.d and forty seven and often afterwards at Charles County afs.d by the same Benjamin Gwinn hath been Requested but the same to him hither to to Pay or him for the same in any sort to Content hath hither to altogether Refused and Still doth Refuse to the Damages of the same Benjamin Gwinn Seven Thousand Six Hundred pounds of Tobacco and therefore suit is brought and so forth Pled.s &C.a John Doe & Rich.d Roe 1747 The Reverend Nathaniel Morill Dr Per Contra Cr To 2 horses sold 4000 By Paper Currency £1.. .. @ 10/200 Tobo Ball 3800 Charles County sst On the Eighteenth day of February One Thousand Seven Hundred & forty seven Came Mr Benjamin Gwinn before me the subscriber one of his Lordships Justices of the Peace for the County aforesaid and made oath on the Holy Evangelists of Almighty God that the above account is just and true and that he hath not Received any Part or Parcel thereof nor any security or satisfaction for the same more then Credit given on the Back of the above account Sworn before Wm Middleton And now here at this day to wit the second Tuesday in March aforesaid Comes as well the said Benjamin by Jeremiah Chase his attorney afs.d as the said Thomas Hungerford ^she^ to which the afs.d writt was Directed And the said Nathaniel altho Solemnly Called Comes not but makes Default Thereupon it is Adjudged by the Court here that the said Thomas Hungerford she be amerced the whole Damages in the Declaration afs.d & Costs to the use of the said Benjamin
Charles County ss.t Daniel Bowen late of Charles County Planter was attached to answer unto Samuel Hanson Jun of a plea of Trespass upon the Case and so forth And Whereupon the same Samuel by Jeremiah Chase his attorney Complains that whereas the said Daniel Bowen the Twenty Eighth day of October in the year of (our) |
