And the said Henry by Philip Key his attorney comes and defends the force & Injury when &C.a and prays leave to Imparle hereto until the Next Court to be holden at Charles Town on the Second Tuesday in March and he hath it and the same day is given to the same George here &Ca At which day to wit the Second Tuesday in March afs.d Comes here as well the said George as the said Henry by their attorneys afs.d and the said Henry by his said attorney Prays further leave to Imparle hereto until the Next Court to be holden at Charles Town on the Second Tuesday in June and he hath it and the same day is given to the same George here &Ca At which day to wit the Second Tuesday in August afs.d Comes here as well the said George as the said Henry by their attorneys afs.d and the said Henry by his said attorney Prays further leave to Imparle hereto until the Next Co to be holden at Charles Town on the Second Tuesday in November and he hath it and the same day is given to the same George here &Ca At which day to wit the Second Tuesday in Nov.r afs.d Comes here as well the s.d George as the said Henry by their attorneys afs.d and the said Henry by his said attorney Prays further leave to Imparle hereto until the Next Court to be holden at Charles Town on the Second Tuesday in March and he hath it and the same day is given to the same George here &Ca And now here at this day to wit the Second Tuesday in March afs.d Comes here as well the said George by his attorney afs.d and the said Henry by his attorney afs.d and the said Henry by his said attorney Comes and defends the force and Injury when &Ca Whereupon all and singular the Premises being by the Court here (according to the Directions of the Act of Assembly in such Cases late made and Provided fully seen heard and understood) and due Deliberation thereupon had It is adjudged and decreed that the said George Recover against the said Henry as well the sum of Three Thousand and Ninety Eight Pounds of Tobacco and Eighteen Pounds fifteen shillings and Three pence Currency for his Damages afs.d as also the sum of One Hundred & forty Nine pound & one Quarter of a Pound of Tobacco for his Costs and Charges by him about his suit in this part laid Def.t in mea out and Expended and the said Henry in Mercy &Ca
This being an action upon the Case for the Recovery of Damages according to an act of assembly of this Province against the Transportation of Persons out of this Province without Passes brought by the said Cornelius Sandford against the said Henry (whereupon) |
