March Court Anno Domini 1747
(359) Whereupon all and Singular the Premises being by the Court here (according to the Directions of the Act of Assembly in such Cases late made and Provided fully seen heard and understood) and due Deliberation thereupon had It is adjudged and Decreed that the said Francis Recover against ^the said^ Henry as well the sum of fourteen Pounds six Shillings and six pence Currency for his Damages afs.d as also the sum of Two Hundred & fifty Thousand & one half Pounds of Tobacco for his Costs & Charges by him about his suit In this part laid out and Expended and the said Henry in Def.t in mea Mercy &Ca
This being an action of Debt for the Recovery of Fifty seven pounds Currency due from the aforesaid John Ensey to the said Wallace & Company the said John Ensey was by Virtue of a Capias ad Respondendum Returnable before his Lordships County Court on the second Tuesday in November in the year of our Lord seventeen Hundred & forty six arrested and then and there appearing It was by Jeremiah Chase attorney for the said Wallace & Company Prayed that the said John Ensey might give special Bail Whereupon Into Court here in their Proper Persons Came Wm Mcpherson John McPherson and Joseph Green of Charles County Planter and becomes pledge and Security for the said John Ensey that if it should happen the afs.d John Ensey in the plea afs.d should be Convict that then the said Wm McPherson John McPherson and Joseph Green yeilded and Granted that as well the Debt afs.d as all Damages which to the same Wallace & Com in this part should be adjudged of their Lands and Chattles should be made and Levied to and for the use of the said Wallace & Company If it should happen the said John Ensey the Debt and Damages afs.d should not Pay or his body into the Custody of the sheriff by Reason thereof Render And the said John Ensey by Thomas Clark his attorney Comes and defends the force and Injury when &C.a and prays leave to Imparle hereto until the Next Court to be holden at Charles Town on the Second Tuesday in March and he hath it and the same day is given to the same Wallace & Company here &Ca At which day to wit the Second Tuesday in March afs.d Comes here as well the said Wallace & Com as the s.d John Ensey by their attorneys afs.d and the said John Ensey by his said attorney prays further leave to Imparle hereto until the Next Court to be holden at Charles Town on the Second Tuesday in June and he hath it and the same same day is given to the same Wallace & Com here &Ca At which day to wit the Second Tuesday in June afs.d Comes here as well the said Wallace & Company as the said John Ensey by their attorneys afs.d and the said John Ensey by his said attorney prays further leave to Imparle hereto until the Next Court to be holden at Charles Town on the Second Tuesday in August and he hath it and the same day is given to the same Wallace & Com here &Ca At which day to wit the Second Tuesday in August afs.d Comes here as well the s.d Wallace & Company as the said John Ensey by their attorneys aforesaid and the said John Ensey by his said attorney prays further leave to Imparle hereto until the (Next) |
