Charles County ss.t John Marten Jun.r late of Charles County Planter was attached to answer unto James Freeman of a plea of Trespass upon the Case And Whereupon the said James by Thomas Clark his attorney Complains for that whereas the said John on the Twenty Sixth day of February In the year of our Lord one Thousand seven Hundred and forty five at Charles County afs.d was Indebted unto the said James In the sum of Twelve pounds Two shillings and Two pence Currency for divers Particulars lying Properly on an account as by a Particular account thereof here with into Court brought may appear and the said John being so thereof Indebted Inconsideration thereof afterwards to wit the day and year last mentioned at the County afs.d upon himself assumed and to the same James then and there faithfully Promised that he the said John the said sum of Twelve Pounds Two shillings and Two pence Currency to the said James would well & truly Content and Pay when thereunto afterwards he should be requested Nevertheless the said John his Promise and Assumption afs.d in form afs.d made notion the least Regarding but minding and fraudulently Intending him the said James in this part Craftily and subtilly to deceive and defraud the said John the said Sum of Twelve pounds Two shillings & Two pence Currency or any part thereof to him the said James hath not Paid or in any sort Contented altho so to do the said John Marten Jun.r was on the first day of December In the year of our Lord One Thousand seven Hundred and forty five and often before and Since at Charles County afs.d by the said James Requested but the said John the said sum of Twelve pounds Two shillings and Two pence Currency or any part thereof to him the said James to pay or in any sort to Content hath hither to altogether Refused and stil doth Refuse to the Damage of him the said James Twenty four pounds four shillings and four pence Currency and therefore it is brought and so forth John Doe & Rich.d Roe 1743 M.r John Marten Jun.r Dr
