Charles County ss.t  Edward Burch late of Charles County was attached to Answer
unto Richard Johns & Elizabeth Morris Executors of the Testament & last Will of
Randolp Morris late of Charles County deceased of a plea of Trespass upon the Case &a

    And Whereupon the said Richard and Elizabeth by Thomas Clark their attorney
complain that whereas the said Edward on the thirteenth day of September In the year
of our Lord Seventeen Hundred & thirty seven at Charles County afs.d was Indebted
unto the said Randolph Morris in his Lifetime in the sum of Three Thousand Six
Hundred & Eighty five pounds of Tobacco and Seventeen pounds Seventeen Shillings &
Eleven Pence Current Money for sundry articles p^r^operly Chargeable in an account as
by a Particular Account thereof herewith into Court brought may appear and the said
Edward being so thereof Indebted in consideration thereof afterwards to wit the same day
and year afs.d at Charles County afs.d assumed upon himself and then & there to the s.d
Randolph Morris in his Lifetime promised that he the said Edward the said Three
Thousand Six Hundred & Eighty five Pounds of Tobacco and Seventeen Pounds Seventeen
Shillings & Eleven pence Current money afs.d to the said Randolph Morris when he
should be thereunto Required would well and truly Content and Pay  Nevertheless
the afs.d Edward his promise & assumption afs.d not Regarding but him the said Randolph
Morris in his Lifetime and the said Richard & Elizabeth after the Death of the said
Randolph Morris in this part to deceive Intending the said Three Thousand six
Hundred & Eighty five pounds of Tobacco & Seventeen pounds Seventeen Shillings &
Eleven Pence Current Money afs.d or any part thereof to the said Randolph Morris
in his Lifetime or to the said Richard and Elizabeth after the Death of the said Randolph
Morris altho Requested by the said Randolph Morris in his Lifetime & by the
Richard & Elizabeth after the Death of the said Randolph Morris To wit the
                      Day of               In the year of our Lord Seventeen Hundred &
at Charles County afs.d hath not Paid but the same to the said Randolph Morris
in his Lifetime & to the said Richard and Elizabeth after the Death of the said Randolph
Morris to pay hath Refused and still doth Refuse to pay the sam to the said Rich.d
and Elizabeth to the Damage of the said Richard and Elizabeth Six Thousand pounds of
Tobacco & Thirty Pounds Current money & therefore they bring suit &C.a and the said Rich.d
& Elizabeth brings hereinto Court the Letters Testamentary of the afs.d Randolph
Morris by which it appears that the said Richard & Elizabeth are Executors of the
Testament afs.d Randolph Morris & thereof to have administration &Ca
