(324) March Court Anno Domini 1747
Charles County ss.t Timothy Carrington late of Charles County Planter was attached to answer unto George Tarvin of a plea of Trespass upon the Case And Whereupon the said George by Henry Darnall his attorney Complains for that whereas the said Timothy on the fourth day of June In the year of our Lord one Thousand Seven Hundred and forty There at Charles County afs.d was Indebted unto the said George In the Sum of Seven Hundred Seventy five and a half Pound of Tobacco for divers Particulars lying Properly in Account as by a Particular account thereof herew.th into Court Brought may appear and the said Timothy being so thereof Indebted in Consideration thereof afterwards to wit the day and year aforesaid in the County afs.d upon himself assumed and to the said George then and there faithfully Promised that he the said Timothy the said Sum of Seven Hundred seventy five and a half Pound of Tob.o to the said George would well and truly Content and Pay when thereunto afterwards he should be Requested Nevertheless the said Timothy his Promise and Assumption afs.d in form afs.d made notion the least Regarding but minding and fraudulently Intending him the said George in this part craftilly and Subtilly to deceive and defraud the said Timothy the said sum of seven Hundred Seventy five and a half pound of Tobacco or any Part thereof to the said George hath not Paid or in any sort Contented altho so to do the said Timothy was on the Day of December In the year of our Lord one Thousand Seven Hundred and forty four and often before and Since at Charles County afs.d by the said George Requested but the said Timothy the said Sum of Seven Hundred Seventy five and a half pounds of Tobacco or any Part thereof to the said George to Pay or in any sort to Content hath hitherto altogether Refused and Still doth Refuse to the Damage of him the said George one Thousand five Hundred and fifty one Pounds of Tobacco and therefore he brings suit &C.a John Doe Pled.s &C.a & Rich.d Roe 1742 Timothy Carrington D.r C.r
And the said Timothy by Philip Key his attorney Comes and defend unto the force and Injury when &C.a and the said Timothy by said attorney prays leave thereof to Imparle hereto until the Next Court to be holden at Charles Town on the second Tuesday in March If he hath it and the same day is given to the same George here &Ca At which day to wit the Second Tuesday in March afs.d Comes here as well the s.d Timothy and the said George by their attorneys afs.d and the said Timothy by his said attorney prays further leave thereof to Imparle hereto until the Next Court to be holden at Charles Town on the Second Tuesday in June and he hath it and the same (day) |
