(320)          March Court Anno Domini 1747

Sustained to the same John Wheatley at his Request by the Court here adjudged
according to the form force and Effect of the statute in those Cases late made and Provided
and that the same John Wheatley have thereof Execution

Judgment for the Plf

Charles County sst  John Sly of Charles County Planter otherwise Called John
Sly of Charles County in the Province of Maryland Planter was surrendered to
answer unto Joseph Allen of a plea that he Render unto him the Penal Sum of one
Thousand Four Hundred pound Merchantable leaf Tobacco in Cask to
Contain the same which to him he owes and from him unjustly Detains &C.a

And whereupon the same Joseph Allen by Henry Darnall his attorney saith
that whereas the afs.d John Sly on the Twenty Second day of June Anno Domini
Seventeen Hundred and forty Two at Charles County afs.d by his Certain Writing
obligatory acknowledged himself to be Bound unto the said Joseph Allen at at
upon the Twenty fifth day of December Next Ensuing the date of the same Writing
Nevertheless the afs.d John altho often Required the afs.d sum of one Thousand four
Hundred pounds of Tobacco as afs.d to the same Joseph hath not Paid but the same to
Pay hath Refused and Stil doth Refuse  Whereupon he says he is the wise and hath
Loss to the Value of one Thousand four Hundred pounds of Tobacco and thefore he brings
seat &C.a and he brings into Court here the Writing obligatory afs.d which the Debt afs.d
in form afs.d Testifys whose Date is the day and year afs.d &Ca                        John Doe

                                                                                                 Pled.s &Ca   Rich.d Roe

And the afs.d John Slye by Jeremiah Chase his attorney comes and defends the
force and Injury when &C.a and prays a hearing of the Writing obligatory afs.d and it
is Read unto him he also prays a hearing of the Condition of the same Writing &
it is Read unto him in these words following Vizt
                                                                         The Condition of the above
Obligation is such that if the above bounded John Sly his Heirs Ex.rs and Adm.rs
do by a Lawfull Course and Legal form make it appear by the Twenty fifth day
of December Next Ensuing the date hereof that the abovesaid Joseph his
Heirs Ex.rs Adm.rs or Assigns hath no Right Title Interest & Claim to a Certain
Tract of land of and lying in Charles County afs.d and being on the Head of
Birds Creek which he the said Joseph Allen hath this day by the Virtue of his
Lordships warrant hath surveyed by William Hanson his Lordships surveyor
for this County then the above obligation to be void of no Effect otherwise to stand in
full force and Virtue in Law as Witness my hand and seal the day and year above
