late of Charles County Innholder if &C.a and him safe keep so that he should have his body before the Justices of the Lord Proprietary of his Next County Court to be holden at Charles Town on the Second Tuesday in March Next to answer unto William M.cpherson of a Plea of Trespass upon the Case and so forth and that he should have then and there that Writt &Ca At which day to wit the Second Tuesday in March aforesaid Comes the aforesaid William Macpherson by Jeremiah Chase his Attorney and offers himself against the said George and the sheriff aforesaid Returns to the Court here that he was taken the body of the said Geor Tarvin And the aforesaid George in his proper Person Comes and defends the force and Injury when &C.a and saith that he Cannot deny the action aforesaid of him the said William nor but that he owes to the said William the sum of Nine pounds Seventeen and Nine pence sterling and no more Whereupon the said William by his Attorney aforesaid prays Judgment and those Damages so acknowledged together with his Costs and Charges by him about this suit in this part laid out and Expended to him to be adjudged Therefore it is Considered that the said William M.cpherson Recover against the said George Tarvin his Damages afs.d to Nine pounds Seventeen shillings and Nine pence sterling above acknowledged and also one Hundred and Ninety Two pounds of Tobacco for his Costs and Charges by him about his suit in this part laid out and Expended on his assent by Def.t in ma the Court here adjudged and the said George Tarvin in Mercy &Ca
was summoned to answer unto John Muschett of a plea that he render unto him the sum of four pounds six shillings and six pence Currency which to him he owes and Unjustly Detains &Ca And Whereupon the same John Muschett by Jeremiah Chase his attry saith that whereas the afs.d John Marten on the Eighth day of April In the year of our Lord Seventeen Hundred & forty five at Charles County aforesaid by his his Certain Writing Obligatory signed with the hands and Name and Sealed with the seal of him the said John Marten and herein Court brought whose date is the day and year afs.d Granted himself to be held and firmly Bound unto the said John Muschett in the sum of four pounds six shillings and six pence Currency to be paid unto the said John Muschett when thereunto afterwards he should be requested Nevertheless the said John Marten altho thereto Requested by the said John Muschett to wit the first day of September in the year and at the County afs.d and often afterwards hath not paid to the said John Muschett the said sum of four pounds six shillings and six pence Currency or any part thereof but hitherto altogether hath and still doth Refuse to pay the same to the Damage of the s.d John Muschett Ten pounds Currency and therefore he brings suit and brings hereinto Court the said Writing Obligatory which gives sufficient process Testimony of the said Debt the date whereof is the day and year above mentioned Pled.s &Ca |
