(304) March Court Anno Domini 1747 Named Petitioner or other Person concerned touching their knowledge of the bounds of the Tract of Land above Named or the bounds of any other Lands between the afs.d Tract or parcel on which it Relates and therefore we Command you any Three or Two of you that you Call and Cause to Come before you any Three or Two of you all Witnesses so Nominated a Certain Day by you or any Three or Two of you to be appointed upon the abovementioned Tract of Land and the Examination of every Witness so called by you that you any Three or Two of you Receive and that same Examination you any Three or Two of you carefully Reduce into Writing on the presence of all parties concerned that be there present and the Examination so taken as aforesaid you any Three or Two of you are to Return to the Justices of our Court with all Convenient under your seals or the seal if any Three or Two of you together with this Writt Provided always that all Parties Concerned living within or without the County aforesaid have Notice according to the Directions of the act of assembly before mentioned of the day and place of the Execution of this our Commission before the Execution thereof and that you any Three or Two of you and to Return to our Justices aforesaid with all Convenient Speed a Certificate of such Notice given together with the Examination of the Witnesses Witness Robert Hanson Gent one of our said Justices of our said Court at Charles Town aforesaid the 10.th day of November in the Thirty Third Year of our Dominion &Ca Anno Domini 1747 Edmd Porteus Clk Issued November 10.th 1747 And now here at this day to wit the second Tuesday in March aforesaid Francis Ware Thomas Morriss and James Keach Thereof the Commissioners afs.d Return to the Court here the Commission afs.d with the subsequent Depositions and Certificate hereunto annext Vizt Charles County sst Janry 1.st 1747 John Huson aged seventy years or thereabouts being sworn on the Holy Evangelists of Almighty God Declares that about Forty six or seven years ago he was known (by a Certain John Hall) that the White oak on w.ch he now lays his hand standing on Branch of Zachiah Swamp that lead's between Mr Henry Hawkins Mr John Marten and Near the Road that lead's from Zachiah New Bridges to Portobacco and likewise near where the said Road Intersects the said Branch and told him that it was a bound one of a Tract or parcel of Land Called Goats Lodge then belonging to John Hawkins Sen and further he sayeth not his John H Huson mark Thomas Morriss aged forty four or thereabouts being sworn as above Declares that about Twenty Eight years ago he was shown the White oak mentioned in the above Deposition by a Certain Thomas Hargis to be a bound Tree of a Tract of Land belonging Thomas Hawkins having a Regard of the said Thomas to the Date hereof which is above Mentioned and further he sayeth not Tho.s Morris Charles County ss.t We the Subscribers Commissioners appointed by the within Commission having first Complyed with the previous Requisites of the Law have met on the within mentioned Tract or parcel of Land called Goats Lodge and did on the first day of January 1747 take the Depositions of such Witness as was then (and) |
