November Court Anno Domini 1747
(287) Samuel being performed obtained Judgment for his said Lordships Writt of Attachment to Issue against the Goods Chattles & Credits of a Certain John Nally for a well the sum of Twelve Hundred and Twenty five pounds of Tobacco Certain Damages as for what Costs had accrued and that should hereafter accrue in and about the Premises It was Commanded the sheriff that of the Goods Chattles and Credits of the said John Nally in his Bailywick being he should attach as well the Damages aforesaid as well as fifteen hundred Pounds of Tobacco for Costs as aforesaid and when the same or any part thereof he had attached that he should have it before the Justices of the ^said^ Lord Proprietary of his Next County Court to be held at Charles Town aforesaid on the second in November Next then and there to be Condemned According to Law to and for the use of the said Samuel unless the said John should Come then and there by himself or Lawfull attorney and answer unto the said Samuel of a plea of Trespass upon the Case and that by Good and Lawfull men of his Bailywick he should make known to the Person or Persons in whose hands he made the same Attachment that he she or they be and appear before the Justices afs.d at the day and Place aforesaid to shew Cause if any he she or they have why the sums in their or any of their hands Attached should not be Condemned and the said Samuel have thereof Execution if &C.a and how he should Execute that Writt that he should make known unto the Justices aforesaid at the day and Place afs.d and that he should have then and there that Writt and the Names of those before whom he should make the same Known &Ca And now here at this day to wit the Second Tuesday in November afs.d Comes the said Samuel by Jeremiah Chase his attorney afs.d and offers himself against the said John on the plea afs.d and one of the Coroners of the Co.ty afs.d Returns to the Court here the WRitt afs.d thus Indorsed Vizt Maryland ss.t To the Worshipfull the Justices within mentioned I hereby Certifie that by Virtue of the within Writt to me Directed that on the 1.st day of October 1747 I attached in the hands of William Nally sundry Effects of the within mentioned John Nally Senr for the use of the within Named Samuel Hanson amounting to the sum of one Thousand Nine Hundred Pounds of Tobacco as appears by schedule of appraism.t hereunto annexed and have made known to the above Garnashee that he be and appear at the Time and Place within mentioned to shew Cause if any he hath why the said Effects so attached in his hands shou'd not be Condemned to and for the use of the said Samuel Hanson according to Law Attached before William Mcpherson Junr and Charles Smoot Good and Lawfull men of my Bailywick as I am hereby Commanded So Answer Sam: Chunn Coroner Wit which Return was Returned the following schedule Vizt Charles County ss.t We the subscribers being Legally summoned and sworn to appraise the Effects of John Nalley for the Use of Samuel Hanson Esq.r high sheriff of the County abovesaid do appraise the same as follows Vizt
