Charles County ss.t William Hopewell late of Charles County Planter was attached to Answer unto Alexander Macclaran and she Jennett his Wife Executrix of the Testament & last Will of Peter Mitchell late of Charles County Merchant Deceased of a plea of Trespass upon the Case and so forth And Whereupon the same Alexander Macclaran and Jennett his Wife by Jeremiah Chase their attorney Complains that whereas the said William on the Eleventh day of Sept.r in the year of our Lord One Thousand Seven Hundred and forty at Charles County afs.d within the Jurisdiction of this Court was Indebted unto the said Peter Mitchell in his Lifetime in the Sum of Seven Hundred and sixteen pounds of Tobacco being for sundry articles lying properly on Account as by the particular account thereof herewith into Court brought may appear and being so thereof Indebted the said William in Consideration thereof Afterwards to wit the day & year aforesaid at the County aforesaid within the Jurisdiction aforesaid upon himself assumed and to the said Peter Mitchell in his Lifetime then and there faithfully Promised that he the said William the said sum of seven Hundred and Sixteen pounds of Tobacco to the said Peter Mitchell in his Lifetime when he should be thereunto afterwards Requested would well and truly Content and pay Nevertheless the said William his Promise and Assumption aforesaid in form afs.d made not in the least Regarding but minding and fraudulently Intending him the said Peter Mitchell in his Lifetime and the afs.d Jennett while she was sole after the Death of the said Peter and the afs.d Alexander & Jennett his Wife after their Intermarriage in this behalf Craftily and Subtilly to deceive and defraud the said W.m the said sum of Seven Hundred and Sixteen pounds of Tobacco or any part thereof to the said Peter in his lifetime or to the said Jennett while she was sole since the death of the s.d Peter to the said Alexander and Jennett his Wife since their Espousals hath not paid (altho so to do the said W.m was on the first day of January in the year of our Lord one Thous.d seven Hundred and forty one and at Charles County afs.d by the said Peter Mitchell in his Lifetime Requested and by the said Jennett whilst she was Sole Since the death of the said Peter on the Second Day of one Thousand seven Hundred and forty at the County and within the Jurisdiction afs.d was Requested and by the said Alexander & Jennett his Wife after their Intermarriage to wit on the Day of seventeen Hundred & forty four at the County and within the Jurisdiction afs.d was Requested but the same to the said Peter in his Lifetime or to the said Jennett whilst she was sole after the death of the said Peter Mitchell or to the said Alexander and Jennett his wife since their Espousals to pay has altogether Refused and Still doth Refuse to pay to the Damage of them the s.d Alexander and Jennett his Wife fourteen Hundred and Thirty Two pounds of Tob.o and in Relation of the Execution of the Testament afs.d and therefore they bring suit and the same Alexander and Jennett his Wife bring hereinto Court the Letters Testamentary afs.d of him the said Peter Mitchell by which it fully appears to the Court here the same Jennett to be Executrix of the Testament and Last Will afs.d and thereof to have Execution and so forth John Doe Pled.s &C.a & Rich.d Roe |
