Charles County ss.t Robert Green late of Charles County Planter was attached to answer unto Ann Clark of a plea of Trespass upon the Case And Whereupon the same Ann by Henry Darnall her attorney complains that whereas the afs.d Robert on the fifteenth day of November in the year of our Lord Seventeen Hundred forty and five at Charles County aforesaid within the Jurisdiction of this Court was Indebted unto the said Ann in the sum of four Thousand pounds of Tob.o as by the particular Account thereof herewith into Court brought may appear and being so thereof Indebted the said Robert in consideration thereof afterwards to wit the day and year afs.d at the County and within the Jurisdiction afs.d upon himself assumed and to the said Ann then and there faithfully Promised that he the said Robert the said Sum of Four Thousand pounds of Tobacco to the said Ann when he should afterwards thereunto Requested would well and truly Content & pay & Also whereas the aforesaid Robert afterwards to wit on the Sixteenth day of Nov.r in the year at the County then the Jurisdiction afs.d in consideration that the afs.d Ann when had at the Instance and Request of him the said Robert Let and hired out to the said Robert a Certain Negroe Slave called Jack the proper Slave of her the said Ann from the fifteenth day of December ^in the year of our Lord Seventeen Hundred forty & four^ to the said fifteenth day of November abovementioned the said Robert did thereupon undertake and to the said Ann did then and there faithfully Promise that he the same Robert would well and truly pay and satisfie to the said Ann where he should be thereunto afterwards Requested such Sums of Tobacco as the afs.d Ann should Reasonably Desire for the Let & hire of her Negroe afs.d and the afs.d Ann in fact saith that she Reasonably Deserves for the Let & hire of her Negroe afs.d for the Term afs.d the sum of Four Thousand pounds of Tobacco and thereof did on the said Sixteenth day of November in the year of our Lord Seventeen Hundred forty & five afs.d at the County and within the Jurisdiction afs.d give notice to the same Robert Nevertheless the same Robert in no wise Regarding his several Promises and undertakings afs.d so as afs.d made but Contriving the same Ann craftily and Subtilly to deceive in this Particular the afs.d Several Sums or any thereof to the said Ann hath not paid nor in any manner satisfied her for the same Altho' to do this the afs.d Robert afterwards to wit on the day of in the year at the County and within the Jurisdiction afs.d was Requested by the said Ann but he hath altogether hither to Refused and still doth Refuse to pay or in ay ways to satisife her for the same By Reason whereof the said Ann saith she is the worse and hath Damage to the Value of Eight Thousand pounds of Tobacco and therefore she brings suit &Ca John Doe Pled.s &C.a & Rich.d Roe 1745 Robert Green D.r Novr 15th To the Hire of my Negroe man Jack from from the 15.th Day of December lls Tob.o last to this day Errors Excepted p Ann Clark |
