Court Anno Domini 1746
(27 Comes and defends the force and Injury when &c.a and says that he Cannot deny the Action aforesaid of him the said Joseph nor but that he did assume upon himself in manner and form as the said Joseph in his Declaration afs.d above against them hath Complained nor also but that the sid Joseph hath sustained Damages by means of not performing the Promises and Assumptions aforesaid to five pounds Nine shillings and Eight Pence Currency as the afs.d Joseph above in Declaring supposes Whereupon the said Joseph by his Attorney aforesaid prays Judgment and those Damages so acknowledged together with his Costs and Charges by him about his suit in this part sustained to him to be adjudged Therefore it is Considered that the said Joseph Recover against the said Charles his Damages to five pounds Nine shillings and Eight pence Currency above acknowledged and also Two Hundred and Thirty Three pounds of Tobacco for his Costs and Charges by him about his suit in this part laid out and Expended on his Assent by the Court here adjudged and the said Charles in mercy &ca
It was Commanded the sheriff that he should take Peter Dent late of Charles County Planter if &Ca and him safe Keep so that he should have his body before the Justices of the Lord Proprietary of his Next County Court to be holden at Charles Town on the Second Tuesday in March Next to satisfy unto Robert Briscoe as well the sum of Nine Hundred pounds of Tobacco which to the same Robert In the Court of the Lord Proprietary before the Justices afs.d were Adjudged for his Damages which he had by a Certain Promise and assumption to the Said Robert at Charles County afs.d made and unperformed as also ^the sum of^ One Thous.d and sixty one pounds of Tobacco which to the same Robert ^of his assent^ was Adjudged for his Costs and Charges by him about his suit in this Part laid out and upended whereof the said Peter is Convict &C.a and that he should have then and there that Memorandum the pll Rule as is 900 Writt &C.a And now here at this day to wit the Second Tuesday in March afs.d the sheriff aforesaid Returns to the Cour here the writt aforesaid thus Indorsed Viz.t Cepi sheriff satisfy'd Sam.l Hanson She |
