                                Then Came John
Atkinson (Attorney in fact for M.r Dan.l
Stephenson) before me the subscriber
one of his Lordships Justices of the
peace and made oath on the Holy
Evangelists that the above Account
is just and True and that he hath not
Received any part nor parcel nor any
security or satisfaction for the same
more than Credit is given to the best of
his Knowledge

And the aforesaid Barton ^in^ his proper person Comes and defends the force & Injury
when &C.a and says that he Cannot deny the Action afs.d of him the said Daniel nor but
that he did assume upon himself in manner & form as the said Daniel above against
him hath Complained nor also but that the said Daniel hath Sustained Damages by
means of not Performing the Promises & Assumptions afs.d to one Thousand four
Hundred Eighty Seven and one third pound of Tobacco as the said Daniel above in
Declaring supposes
                                                 Whereupon the said Daniel by Jeremiah Chase
his Attorney afs.d prays Judgment and those Damages so acknowledged together with
his Costs & Charges by him about his suit in this part laid out and Expended to him to
be adjudged
                                                Therefore it is Considered by the Court here that the s.d
Daniel Stephenson do Recover against the said Barton Hungerford Senior his
Damages aforesaid to one Thousand four Hundred Eighty Seven and one Third
pound of Tobacco above acknowledged as also the sum of Two Hundred and
Twenty four pounds of Tobacco for his Costs and Charges by him about his
Suit in this part laid out and Expended on his Assent by the Court here adjudged
Def.t in mea   and the said Barton Hungerford Sen.r in Mercy &Ca
