Hundred and seventy six pounds of Tobacco for his Costs & Charges by
him about his suit in that part laid out & Expended on their assent

Charles County ss.t  Richard Howard late of Charles County Planter was Attached
                               to answer unto Chrisr Lowndes & Com of a plea of Trespass upon the Case
And Whereupon the said Chris.r & Company by Henry Darnall their attorney
Complain for that whereas the said Richard on the Twenty Third day of January in
the year of our Lord one Thousand seven Hundred & forty six at Charles County afs.d was
Indebted unto the said Chris.r & Com In the Sum of one Thousand & Forty Eight pounds of
Tobacco for divers particulars lying properly in account as by a Particular Account
thereof herewith into Court brought may appear and the said Richard being so thereof
Indebted in Consideration thereof afterwards to wit the day and year afs.d in the County
afs.d upon himself assumed and to the same Chris.r & Com then and there faithfully
Recorded that he the said Richard the said sum of one Thousand and forty Eight pounds of
Tobacco to the said Chris.r & Company and do well and truly Content and pay when thereunto
afterwards he should be Requested  Nevertheless the said Richard his Promise and
Assumption afs.d in form afs.d are not in the least Regarding but minding and
fraudulently Intending them the said Chris.r & Com in this part craftily and subtilly
to deceive and defraud the said Richard the said sum of one Thousand & forty Eight pounds
of Tobacco or any part thereof to the said Chris.r & Com hath not paid or in any sort Contented
altho so to do the said Richard was on the fourth day of september in the year of our Lord
one Thousand seven Hundred and forty seven and often before and since at Charles
County afs.d by the said Chris.r & Com Requested but the said Richard the said sum of one
Thousand and forty Eight pounds of Tobacco or any part thereof to the said Chrisr & Com to pay
or in any sort to content hath hither to altogether Refused and stil doth Refuse to the
Damage of the said Chris.r & Com Two Thousand & Ninety six pounds of Tobacco & therefore
