233 afterwards he should be requested well and truly would Content and Pay Nevertheless the said James Mudd his Promise and assumption afs.d not Regarding but minding and fraudulently Intending the said Walter in this Part craftily and subtilly to deceive and defraud the Said James the said sum of Eight Hundred and seventy three pounds of Tobacco or any Part thereof to the same Walter Hanson hath not paid nor him for the same in any sort Contented altho' the said James Mudd afterwards to wit the Twentyeth day of August in the year and at the County afs.d and often since by the said Walter Hanson hath been thereunto requested But the same to him hitherto to Pay or him for the same in any sort to Content the said James hath hither to Altogether Refused and still doth Refuse to the Damage of the said Walter Hanson One Thousand Seven Hundred and forty six pounds of Tobacco and therefore he brings suit and so forth John Doe Pled.s &C.a & Rich.d Roe
And the aforesaid James in his proper person Comes and defends the force and Injury when &C.a and says that he Cannot deny the action afs.d of him the said Walter nor but that he did Assume upon himself in manner and form as the s.d Walter above against him hath Complained nor also but that the said James hath Sustained Damages by means of not Performing the Promises & Assumptions afs.d to Eight Hundred and Seventy Three pounds of Tobacco as the said Walter above in Declaring Supposes Whereupon the said Walter by Jeremiah Chase his attorney afs.d prays Judgment and those Damages so acknowledged together with his Costs & Charges by him about his suit in this part laid out and Expended to him to be adjudged (Therefore) |
