(232) November Court Anno Domini 1747 At which day to wit the second Tuesday in November afs.d Comes the said Robert by Jeremiah Chase his attorney and offers himself against the said Joseph and the sheriff afs.d Namely Thomas Hungerford Gent Returns to the Court here that he has taken the body of the said Joseph Whereupon into Court here in his proper person Comes William Macpherson Jun of Charles Co.ty Planter and becomes pledge and Security for the afs.d Joseph that if it should happen that the afs.d Joseph in the plea afs.d should be Convict that then the s.d William Yeilded and Granted that as well the Debt afs.d as all Damages w.ch to the same Robert in this part should be adjudged of his Lands & Chattles should be made and Levied to and for the use of the said Robert if it should happen the said Joseph the Debt & Damages afs.d to the said Robert should not pay or his body into the Custody of the sheriff by Reason thereof Render And the afs.d Joseph in his proper Comes and defends the force and Injury when &C.a and Saith that he Cannot deny the Action afs.d of him the said Robert nor but that he owes to the said Rob.t the sum of and no more Whereupon the said Rob.t by his attorney afs.d prays Judgment and those Damages so acknowledged together with his Costs and Charges by him about his suit in this part sustained to him to be adjudged Therefore it is Considered that the said Robert Recover against the said Joseph his Damages to above Acknowledged and also Pounds of Tobacco for his Costs and Charges by him about his Suit in this part laid out and Expended on Def.t in mea his assent by the Court here adjudged and the said Joseph in Mercy &Ca
Charles County ss.t James Mudd late of Charles County Planter was attached to Answer unto Walter Hanson of a Plea of Trespass upon the Case and so forth And Whereupon the same Walter by Jeremiah Chase his attorney Complains that Whereas the said James the fifth day of August in the year of our Lord One Thousand Seven Hundred and forty Seven at Charles County afs.d was Indebted to the said Walter Hanson In the Sum of Eight Hundred and Seventy Three pounds of Tobacco for divers particulars lying properly in an Account as by the particular Account thereof herewith into Court brought may appear and being so thereof Indebted the said James Mudd in Consideration thereof afterwards to wit the day and year afs.d at the County afs.d upon himself Assumed and to the said Walter then and there faithfully promised that he the said James Mudd the said sum of Eight Hundred & Seventy Three pounds of Tobacco to the said Walter Hanson when thereunto (afterwards) |
