(221) Samuel in this part should be adjudged of his Lands & Chattles should be made and levied to and for the use of the said Samuel that if it should happen that the said Casandra the Damages & Costs afs.d to the said Samuel should not Pay or his body into the Custody of the sheriff by Reason thereof Render And the said Casandra by Henry Darnall his attorney Comes and defends the force and Injury when &Ca and prays leave thereof to Imparle hereto until the Next Court to be holden at Charles Town on the second Tuesday in March Next and he hath it and the same day is given to the same Samuel here &Ca And now here at this day to wit the second Tuesday in March afs.d Comes as well the said Casandra as the said Samuel by their attorneys afs.d and the said Sam.l by his attorney afs.d prays Judgment that the said Casandra to his Declaration aforesaid against him may answer and the said Casandra by her attorney afs.d Comes and defends the force and Injury when &C.a and the same attorney says that he is not Informed of any answer to the said Samuel for the said Casandra in the plea afs.d to be given and nothing other thereof does he say whereby the same Sam.l Remain against the said Casandra thereupon without Defence It is therefore Considered by the Court here that the said Samuel do Recover against the said Casandra his Damages by occasion of the Premises to Two Thousand four Hundred and Sixty pounds of Tobacco as also four Hundred and fifteen Pounds of Tobacco for his Costs & Charges by him about his suit in this part laid out and Expended to the said Samuel Def.t in mea of his assent by the Court here adjudged and the said Casandra in Mercy &Ca
It was Commanded the sheriff that he should take Robert Minion late of Charles County Blacksmith if &C.a and him safe keep so that he should have his body before the Justices of the Lord Proprietary of his Next County Court to be holden at Charles Town on the second Tuesday in November Next to satisfie unto William Neale as well the Sum of Two Thousand one Hundred and Ninety Eight Pounds of Tobacco which to the said William in the County the said Lord Proprietary before the Justices afs.d were adjudged for his Damages which he had by occasion of a Certain Promise and assumption to the said William by the said Robert at Charles Co.ty aforesaid made and unperformed as also Three Hundred and Ninety Eight Pounds of Tobacco which to the same William of his assent were adjudged for (his) |
