(219) Defends the force and Injury when &Ca and the same attorney says that he is not Informed of any answer to the said Nathaniel for the said William in the plea afs.d to be given and nothing other thereof does he say whereby the same Nathaniel Remains against the said W.m thereupon without Defence It is therefore Considered by the Court here that the said Nathaniel ^do^ Recover against the said W.m his Debt by occasion of the Premises to Eleven Thousand five Hundred & Twenty Six pounds of Tobacco according to the Declaration afs.d as also Three Hundred and forty Pounds of Tob.o for his Costs & Charges by him about his suit in this part laid out and Expended to the said Nathaniel of his assent by the Court here adjudged and the said William Def.t in mea in Mercy &Ca
Charles County ss.t Casandra Mudd late of Charles County Widow was attached to answer unto Samuel Hanson Jun High Sheriff of Charles County afs.d of a plea of Trespass upon the Case and so forth And Whereupon the same Samuel by Jeremiah Chase his attorney Complains that whereas the said Casandra the Day of June in the year of our Lord one Thousand Seven Hundred and forty Seven at Charles County afs.d was Indebted to the said Samuel In the sum of Two Thousand four Hundred and Sixty pounds of Tobacco for such arti^c^les as lye properly in an Account as by the particular Account thereof herewith into Court brought may appear and being so thereof Indebted the afs.d Casandra in Consideration thereof afterwards to wit the day and year afs.d at the County afs.d upon herself assumed and to the said Samuel then and there faithfully Promised that she the afs.d Casandra the said sum of Two Thousand four Hundred and Sixty pounds of Tobacco to the said Samuel when thereunto afterwards she should be requested well & truly would Content and pay Nevertheless the s.d Casandra her Promise and Assumption afs.d not Regarding but minding and fraudulently Intending the same Samuel in this part craftily and Subtilly to deceive and defraud the s.d Casandra the said sum of Two Thousand four Hundred and Sixty pounds of Tobacco or any part thereof to the said Samuel hath not paid nor him for the same in any sort Contented altho the aforesaid Casandra afterwards to wit the first day of July in the year and at the County aforesaid and often since by the same Samuel hath been there unto Requested but the same to him the said Casandra hitherto to Pay or him for the same in any sort to Content hath hither to altogether Refused and still doth Refuse to the Damage of the said Samuel four Thousand Nine Hundred and Twenty Pounds of Tobacco and therefore Suit is brought and so forth John Doe Pleds &Ca & Rich.d Roe |
