(143) Tuesday in June last by the Oath of fourteen Jurors Namely Thomas Matthews &C.a was Presented Mary Wetherington for Bearing a Bastard Child And now here at this day to with the Second Tuesday in August afs.d the afs.d Mary in Custody of the Sheriff Namely Samuel Hanson Gent to the Barr here Brought in her Proper Person Comes and being Demanded of her by the Court here wether she be Guilty of the Bastardy afs.d above upon her Imposed she the said Mary Witherington says she is thereof Guilty in manner and form as by the Present^ment^ aforesaid against her it is Adjudged Therefore it is Considered that the said Mary be fined or suffer Corporal Punishment according to the Directions of the Act of Assembly in those Cases late made and Provided and for that the said Mary Cannot Pay or Procure any Person to be Security for the fine afs.d by the Act afs.d Imposed It is ordered the sheriff that he take her to the Whipping Post and having strip'd her Naked from the Waist upwards and their give her Twelve Lashes on the Bair Back for her offence afs.d And afterwards to wit the same Second Tuesday in August aforesaid the Sheriff aforesaid Returns to the Court here that he hath done Execution of the said Judgment upon the afs.d Mary Whereupon into Court here in his Proper Person Came Thomas Freeman of Charles County Planter and becomes Pledge and Security for the afs.d Mary to pay the several fees arisen Due to the officers and ministers of the Court here by occasion of the Premises Ruled that the said Mary Witherington Recognize In the sum of Forty Pounds Currency money with one security in the sum of Twenty Pounds Like money to Keep the County ^of Charles^ Clear from any burthen of the said bastard Child whereof she is ^this^ Day Convict Whereupon into Court here in her Proper Person Comes the said Mary Witherington and acknowledged her self to owe and stand Justly Indebted unto his Lordship the Lord Proprietary In the sum of Forty Pounds Current money of Maryland and also in like manner Came Thomas Freeman ^of same County Planter^ and Acknowledged himself to owe and stand Justly Indebted unto his said Lordship Yeilded and Granted should be made and leyved on their and each of their Bodys Goods or Chattles Lands or Tenements for the use of his said Lordship his Heirs and Successors On Condition that the said Mary Witherington do Keep Harmless & Indemnified the County of Charles from any Burthen of a Bastard Child Named Chloe Tilder Withering she the said Mary was this day Convict |
