June Court Anno Domini 1747
(117) Whereupon it was Commanded the sheriff that of the Goods Chattles & Credits of the aforesaid Edward Murphy on his Bailywick being he should Attach as well the sum of Two Pounds Paper Currency Damages as five Hundred Pounds of Tobacco for Costs that had accrued and that further money ^should^ Accrue in Prosecution of the Premises and when the same he had attached or any Part thereof that he should have it before the Justices of the said Proprietary of his Next County Court to be held at Charles Town on the Second Tuesday in June Next then and there to be Condemned according to Law to and for the use of the said John unless the said Edward should Come then and there by himself or lawfull attorney and answer unto the said John of a plea of Trespass upon the Case and that by Good and Lawfull men of his Bailywick he should make known to the Person or Persons in whose hands he should make the same attachment that he she or they be and appear before the Justices of the said Lord Propry at the Place and time afs.d to shew Cause if any he she or they have why the sum in their or any of their hands attached shou'd not be Condemned according to Law and the said John have thereof Execution if &C.a and how he should Execute that Writt that he should make Known to the Justices afs.d at the Time and Place afs.d and that he should have then and there that Writt and the Names of those before whom he should make the same Known &Ca And now here at this day to wit the Second Tuesday in June aforesaid Comes the said John in his Proper Person and offers himself against the said Edward in the Plea afs.d and the sheriff afs.d Returns to the Court here the Writt afs.d thus Indorsed Charles County sst Be it Known to the Worshipfull the Justices within mentioned that by Virtue of this Precept I have attached of the within Named Edward Murphy Sundry Goods and Chattles as by a schedule hereto annexed appears for the use of the within Named John Winn June ye 9.th 1747 so answers S Hanson She With which Return was Returned the following Schedule Vizt Charles County ss.t We the subscribers being summoned and sworn by the sheriff of the said to appraise and Value Sundry Goods and Effects of Edward Murphy late of Charles County Blacksmith and for the Use of M.r John Winn of Prince Georges County Planter do appraise and value as follows Viz.t
Given under our hands and seals this Eighth Day of June Anno Dom 1747 James Smallwood (ss) Henry Acton (ss) his Benj.a B Cawood (ss) W.m W Baggott (ss) Whereupon the said John Winn in his Proper Person ^Comes^ and Prays Condemnation of the Effects afs.d so as afs.d as by the Schedule afs.d amounting to one Pound seventeen shillings and six Hundred Pounds of Tobacco w^i^th Execution thereof to him to be adjudged and the said Edward Murphy altho solemnly Called Comes not but makes Default (Therefore) |
