108)               June Court Anno Domini 1747

Inconsideration thereof afterwards to wit the day and year afs.d in the County afs.d
upon himself Assumed and to the same William then and there faithfully
Promised that he the said Robert the said Sum of Two Thousand one Hundred
and Ninety Eight Pounds of Tobacco afs.d to the same William would well & truly
Content and Pay when thereunto afterwards he should be requested  Nevertheless
the said Robert this Promise and Assumption afs.d in form afs.d made not
in the least Regarding but minding and fraudulently Intending him the said
William In his Part Craftily and Subtilly to deceive and defraud and defraud the s.d
Robert the said Sum of Two Thousand One Hundred and Ninety Eight Pounds of
Tobacco or any Part thereof to him the said William hath not Paid or in any sort
Contented altho so to do the said Robert was on the Second Day of March In the year of
our Lord one Thousand Seven Hundred and forty six and often before & since
at Charles County afs.d by the said William Requested but the said Robert the s.d
sum of Two Thousand one Hundred and Ninety Eight Pounds of Tobacco or any
Part thereof to him the said William to Pay or in any sort to Content hath hitherto
altogether Refused and still doth Refuse to the Damage of him the said W.m
Four Thousand Three Hundred and Ninety six Pounds of Tobacco and therefore
suit is brought and so forth                                                                     John Doe

                                  I hereby Certifie that the above Account was Legally Proved
on March the 7.th 1746 before me the subscriber one of his Lordships the Lord
Propry Justices for the County afs.d and that this is a true Copy of the
above Named William Neales Booke in folio (61)

Whereupon into Court here in his Proper Person Came Robert Franklin of
Charles County Blacksmith and became Pledge and Security for the afs.d Robert
Minion that if it should happen the said Robert Minion in the Plea aforesaid
should be Convict that then the said Robert Franklin yielded and Granted that
as well the Damages afs.d as all Costs which to the said William Neale in this
Part should be adjudged of his Lands & Chattles should be made & Levied to and
for the use of the said Wm Neale if it should happen the said Robert Minion the
Damages and Costs afs.d to the afs.d William should not Pay or his body into the
Custody of the Sheriff of the County afs.d by Reason thereof Render
