96 And the aforesaid Henry Lawrance in his proper person Cometh and defendeth the force and Injury when &.a and prayeth Leave thereof to Imparle here untill next Court to be held at dividing Creek the third Tuesday of November then next following and he hath it and the same day is given to the aforesaid John here also &a Att which day here Came again as well the af.d John Henry by Robert Jenckins Henry his Attorney ^afd^ as the af.d Henry Lawrance in his proper person and whereupon the said Henry Lawrance prays further leave thereof to Imparle here untill next Court to be held at dividing Creek the third Tuesday of March ^then^ next Following and he hath it and the same day is given to the af.d John here also &a Att which day here Came againe as well the af.d John Henry by Robert Jenckins Henry his Attorney as the af.d Henry Lawrance in his proper person And whereupon the said Henry Lawrance saith that he Cannot deny the Action af.d of the af.d John John Henry nor but that he did assume upon himself in manner and form as the af.d John Henry above against him hath Complained and as to the damage of the same John by him by Occasion of the premisses in that part sustained the same Henry Lawrance saith and acknowledgeth that the af.d John hath sustained damages by Occasion of the premisses beyond his Costs and Charges by him about his suit in that part apposed to twenty pounds three shillings and five pence half penny and not more and because the af.d John denys not this but the same allegations grants to be true prays Judgment for those damages above acknowledged together with his Costs and Charges af.d to him to be adjudged &c Therefore by Consent of the parties af.d it is Considered that the af.d John Henry recover against the af.d Henry Lawrance his damages af.d to the af.d twenty pounds three shillings and five pence half penny & three hundred and fifty five pounds of tobacco 355 by the same Henry in form af.d acknowledged as also pounds of tobacco for his Costs and Charges af.d to the same John at his request by the Court now here of the assent of the parties af.d adjudged and the af.d Henry in mercy &.c
thousand seven hundred and forty with force and arms at the parish afd in the County afd Seven Turkeys of the price of Twenty pounds of tobacco each Turkey of the Goods and Chattles of a Certain James Longo then and there found then and there feloniously did steal take and bear away Contrary to the peace of the said Lord Proprietary that now is his good rule and Government and against the form of the act of assembly in such Case lately made and Provided Testes James Longo Joseph Stolsten Robinson Lingo John Purduenex Nath.ll Willis On the foregoing deed Bill of Indictment it was endorsed as Followeth vizt Ignoramus Parker Selby foreman
