1740 8 The Condition of the above obligation is such that whereas the Commissary Genll hath transmitted unto this Court the Account of the estate of John Turpin dec.d wherein it is found that there is Ballance due to the abovesaid Orphans the sum of thirty five pounds ten shillings and One penny Currt money of maryland therefore if the abovesaid Hannah Turpin W.m Turpin Geo Benston and Solomon Long their or any or either of their heirs Ex.rs or Adm.rs shall and do well and truely pay unto the abovesaid Orphans the sum of thirty five pounds ten Shillings & one penny According to Act of assembly and the dec.d will when they shall arrive at full age to receive the same &.a then the above obligation to be void and of none effect otherwise to remain in full force and vertue &.a her Signed Sealed and delivered Hannah @ Turpin (seal) mark In the presence of us W.m Turpin (seal) Ring Geo Benston (seal) 1731 John Miller Solomon Long (seal)
af.d Francis here &.c Att which day here Came the aforesaid Francis Allen Jun.r by Francis Allen Sen.r his Attorney and the sheriffe to wit John Henry Gent now here returned that he had taken the af.d Robert Geddes whose body here at this day he had ready to answer the af.d Francis Allen of the af.d plea as to him it was Commanded And hereupon the said Robert Geddes putts in his place George Douglas Gent attorney ^at Law^ of against the aforesaid Francis Allen Junr of the aforesaid plea Whereupon at the request of the parties aforesaid day is to them here given untill next Court to be held at dividing Creek the third tuesday of March then next following in the Same State as at present saving to the parties afd &a Att which day here Came againe the parties ^afd^ by their attorneys aforesaid and hereupon the said Francis Allen Junr Complained against the afd Robert Geddes in the plea aforesaid in form following Somerset County ss.t Robert Geddes late of Somerset County Inholder was Attached to answer unto Francis Allen Jun.r of a plea of trespass upon the Case &.c And Whereupon the said Francis Allen Jun.r by Francis Allen Sen.r his Attorney complains that whereas he the said Francis Allen Jun.r is a good true faithfull and honest Subject of our Lord the King now and as a good true faithfull honest and honest Subject of our said Lord the King and his Progenitors late Kings of Great Brittain &c from the time of his nativity hetherto |
